FOR CONSTRUCTION OF A 48,000 SQUARE FOOT RESEARCH AND DEVELOPMENT BUILDING LOCATED AT 9714 10TH AVENUE NORTH (2003 118) WHEREAS, Banner Engineering Corp. has requested approval of a preliminary and final plat for Banner 2"a Addition, a plat consolidating three lots into one lot on 11.42 acres located at 9714 10"' Avenue North; and WHEREAS, the property is legally described as follows: Parcel A: Lot 1, Block 1, BANNER ADDITION, Hennepin County, Minnesota. (TORRENS) Parcel B: The west 200 feet of the east 1097.5 feet of the south 435.6 feet of the northeast quarter of the northeast quarter of Section 36, Township 118, Range 22, subject to road. (ABSTRACT) Parcel C: The west 217.5 feet north 225 feet of the south 660.6 feet of the northeast quarter of the northeast quarter of Section 36, Township 118, Range 22, subject to road. (ABSTRACT) WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Banner Engineering Corp. for a preliminary and final plat for Banner Second Addition, subject to the following conditions: Resolution 2004-034 Preliminary and Final Plat (2003118) Page 2 1. This preliminary and final plat approves three lots consolidated into one lot, in accordance with the plans received by the City on December 16, 2003, November 20, 2003 and October 23, 2003, except as amended by this Resolution. 2. Prior to issuance of a building or grading permits, the applicant shall install the tree preservation fencing and submit the required financial guarantee. 3. Development standards shall be as required by the I-2 district. No variances are granted or implied. 4. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. No building permits shall be issued until the final plat is filed and recorded with Hennepin County and proof of recording is received by the City. Copies of all recorded documents shall be submitted to the City. d. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility.
