RESOLUTION 2004-014
REIMBURSING DEVELOPER FOR
CONSTRUCTION OF PUBLIC IMPROVEMENTS
IN THE RESERVE (20092)
WHEREAS, the City of Plymouth and Rottlund Company, Inc. have entered into a
development contract dated July 11, 2001; and
WHEREAS, as part of this development, the developer was required to constrict public
improvements including watermain; and
WHEREAS, the City is responsible for the incremental cost of public improvements above
that which is the responsibility of the developer under the City Assessment Policy; and
WHEREAS, the work has been completed and is certified to be in compliance with the
approved plans and specifications by Rottlund Homes, Inc.'s engineer, Pioneer Engineering;
and
WHEREAS, the cost difference between a 12" watermain (developer's responsibility) and
the Comprehensive Water Supply Plan required 20" and 24" watermain (City responsibility)
amounts to $148,541.89 for constriction and $17,825 for engineering; and
WHEREAS, the work has been accepted by the City of Plymouth;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the developer, The Rottlund company, Inc.,
be reimbursed in the amount of $166,366.89 for constriction and engineering costs for the
watermain oversizing in accordance with the development contract and City policy.
BE IT FURTHER RESOLVED that $166,366.89 be allocated from the City's Utility Trunk
Fund.
Adopted by the City Council on January 13, 2004.
