RESOLUTION NO. 2005-480
AUTHORIZING THE VACATION OF
TRAIL EASEMENT WITHIN PARCEL KNOWN AS
SECTION 16-118-22-22-0004 AND LEGALLY DESCRIBED
IN DOCUMENT # 7046952 RECORDED 1/29/1999
WHEREAS, a public hearing with respect to said vacation was scheduled for December 13, 2005 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of December 13, 2005; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on December 13, 2005 to inform any and all
interested parties relevant to the vacation of the trail easement within 16-118-22-22-0004; and
WHEREAS, it was determined by the City Council that said trail easement is not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following trail easement be vacated:
A 30 foot perpetual easement for public trail purposes over, under, across and through
part of the above property described as follows. The centerline of said perpetual
easement is described as commencing at the northwest corner of said Section 16; thence
easterly along the north line of said Section 16 a distance of 1451.53 feet to the point of
beginning of said centerline; thence southwesterly deflecting to the right 156 degrees 59
minutes 00 seconds a distance of 106.16 feet; thence southwesterly deflecting to the left

21 degrees 09 minutes 39 seconds a distance of 98.65 feet; thence southwesterly
deflecting to the left 22 degrees 14 minutes 39 seconds a distance of 76.39 feet; thence
southwesterly deflecting to the right 35 degrees 11 minutes 47 seconds a distance of
128.89 feet; thence southwesterly deflecting to the left 12 degrees 57 minutes 39
seconds a distance of 136.62 feet; thence southwesterly deflecting to the right 23
degrees 56 minutes 54 seconds a distance of 195.61 feet; thence southwesterly
deflecting to the left 27 degrees 59 minutes 39 seconds a distance of 287.82 feet; thence
southwesterly deflecting to the right 25 degrees 48 minutes 05 seconds a distance of
136.72 feet; thence southwesterly deflecting to the left 23 degrees 20 minutes 35
seconds a distance of 70.00 feet; thence southwesterly deflecting to the left 21 degrees
00 minutes 00 seconds a distance of 100.00 feet; thence southwesterly deflecting to the
right 27 degrees 01 minutes 00 seconds a distance of 78.45 feet; thence southwesterly
deflecting to the left 23 degrees 53 minutes 39 seconds a distance of 60.00 feet; thence
southerly deflecting to the left 19 degrees 27 minutes 10 seconds a distance of 90.79
feet; thence southeasterly deflecting to the left 14 degrees 58 minutes 09 seconds a
distance of 287.67 feet; thence southeasterly deflecting to the left 36 degrees 54 minutes
16 seconds a distance of 110.00 feet; thence southwesterly deflecting to the right 53
degrees 00 minutes 00 seconds a distance of 40.00 feet; thence southwesterly deflecting
to the right 34 degrees 54 minutes 20 seconds to the centerline of said Rockford Road
and said described centerline there terminating.
The sidelines of said perpetual easement are to be prolonged or shortened to terminate
at the north and south lines of the above described property.
FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains
and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or
portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
