HomeMy WebLinkAboutCity Council Resolution 2005-447CITY OF PLYMOUTH RESOLUTION 2005-447 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "TARYN HILLS" FOR U.S. HOME CORPORATION, FOR 237.6 ACRES OF LAND LOCATED EAST OF VICKSBURG LANE, NORTH AND SOUTH OF COUNTY ROAD 47 (2005045-F) WHEREAS, U.S. Home Corporation has requested approval of a final plat for phase 1 development to allow the creation of 235 residential lots and several outlots on 237.6 acres of land located east of Vicksburg Lane, north and south of County Road 47; and WHEREAS, the property is legally described as follows: That part of the Northwest Quarter of the Northwest Quarter of Section 4, Township 118, Range 22, lying northerly of the center line of County Road No. 47, as the same is laid out and as described in highway easements Document Numbers 543453 and 543454. l All that part of the following described Pars 1 and 2. That part of the Northwest Quarter of Section 4, Township 118, Range 22, described as follows: Commencing at the Northeast corner of said quarter -section; thence south along the East line of said quarter -section to a point which is 915.5 feet North of the South line of said quarter -section; thence in a Westerly direction 1316.5 feet to a point 942.3 feet North measured at right angles from the South line of said Northwest Quarter; thence northerly at an angle to the right of 86 degrees and 45 minutes a distance of 401 feet; thence West at an angle to the left of 87 degrees and 54 minutes a distance of 896.2 feet to a point 1343.5 feet North of the South line of said Northwest Quarter and 396 feet east of the west line of said section; thence North parallel with the West line of said section to a point in the North line of said section a distance of 396 feet East of the Northwest corner of said section; thence East to the point of beginning; excepting Resolution 2005-447 (2005045-F) Page 2 therefrom that part included in the East 1/2 of the Northwest Quarter of said Section, Township and Range. Which lies Southerly of the center line of County Road 47 as the same is laid out and as described in highway easement Doc Nos. 543453 and 543454. The East '/z of the Northwest Quarter of Section 4, Township 118, Range 22 West, except a parcel described as commencing at the Southeast corner thereof, thence North along the East line of said Northwest Quarter, 915.5 feet, thence West at an angle of 88 degrees and 43 minutes to the left from said line a distance of 1316.5 feet to a point 942.3 feet North of and measured at right angles to the South line of said Northwest Quarter, thence South to the South line of said Northwest Quarter, thence East to place of beginning, and except that part thereof lying northerly of County Road No. 47, and except that part of the above described property lying West of a line and its Northerly extension, drawn from a point on the South line of the above described parcel distant 274.67 feet East from the Southwest corner of said parcel to a point on the centerline of said County Road No. 47 distant 300.74 feet, as measured along said centerline, from the West line of said East '/z of Northwest Quarter, according to Government Survey thereof. Resolution 2005-447 (2005045-F) Page 4 WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by U.S. Home Corporation for a final plat for Taryn Hills; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approves 235 residential lots and several outlots, in accordance with the plans received by the City on November 16, 2005 and the revised final plat received by the City on December 7, 2005, except as may be amended by this Resolution. 2. Approval of this final plat is contingent upon City Council approval of the development contract for Taryn Hills. 3. The development shall comply with all standards specified by the Zoning Ordinance. No variances are granted or implied, except that a lot width variance was previously approved for Lot 8, Block 6. 4. Prior to the City's issuance of building permits for any dwelling unit, the developer shall dedicate and convey Outlot J to the City by warranty deed, free and clear of any and all encumbrances. The dedication of this outlot constitutes 72.11 percent of the land dedication required for all of "Taryn Hills" excluding Outlot A (the commercial site) and Outlot B (the Common Bond site). (The park dedication requirement for fiiture development of Outlots A and B shall be cash fee in lieu of land dedication, in accordance with Section 528 of the Plymouth City Code.) In combination with land dedication of Outlot J, the developer shall pay a cash contribution to satisfy the remainder (27.89 percent) of the City's park dedication requirement. The developer shall pay a cash contribution equaling 27.89 percent of the "per unit maximum cash payment" for each of the 522 new dwelling units within the Taryn Hills development, excluding Outlots A and B. The cash fee shall be payable prior to the City's release of the signed final plat mylars, based on the number of new dwelling units within each final plat phase. For each final plat phase, the park dedication fee shall be calculated based on the "per unit maximum cash payment" in effect at the time the final plat is recorded. 5. Prior to the City's release of the signed final plat mylars, the developer shall convey Outlot E to the City by warranty deed. This outlot will be a segment of the Three Rivers Park District regional trail corridor. Upon invoice from the developer, the City shall reimburse the Resolution 2005-447 (2005045-F) Page 5 developer $37,700 within thirty (30) days after the deed for Outlot E has been recorded with Hennepin County. 6. Prior to recording the final plat, the developer shall submit homeowners association documents for City review, to ensure that maintenance of the association common spaces including sidewalks, landscaped medians, and similar features. The HOA documents shall include language prohibiting storage in the parking spaces of the multi -family areas—including storage of recreational vehicles. 7. In conjunction with recording of the final plat, the developer shall provide a ten -foot wide trail easement on lots/outlots abutting the east side of Vicksburg Lane, and on lots/outlots abutting both sides of CR 47 within the plat. 8. Prior to impacting any wetlands, the developer shall receive City Council approval of the wetland replacement plan. 9. The developer shall notify potential buyers near the planned regional trail of the regional trail plans, and shall post signage on the site regarding the fiiture regional trail. 10. The developer shall post signage at the south end of Orchid Lane identifying the existing private driveway as "private". 11. The developer shall notify potential buyers about fiiture roadway expansion and improvement projects for CR 47 and Vicksburg Lane, and shall post signage on the site regarding such fiiture roadway projects. 12. Compliance with the City's tree preservation regulations, in accordance with the approved preliminary plat. 13. The developer shall include tree protection fencing on the plans for the trees to be preserved. Such fencing shall remain in place until all constriction in the area is completed. 14. The developer shall provide a rain garden agreement for maintenance of the rain gardens. 15. To the greatest extent feasible, the developer shall employ directional drilling or jacking in the constriction of the sanitary sewer south of Trunk Manhole 412 in order to minimize tree removal. 16. Prior to issuance of building permits, permanent wetland buffer monument signs must be installed pursuant to ordinance requirements. Resolution 2005-447 (2005045-F) Page 6 17. When the site plan is submitted for future development of the commercial area within the plat, appropriate land use transitions shall be provided between the commercial area and the townhomes located to the north and east. 18. Prior to recording of the final plat, the developer shall revise the final plat and plans as follows: a. Means to locate all sewer and water services using radio frequency locating equipment such as Metro Tech in accordance with Minnesota Rules 7560 must be provided. b. Add a signature line on the plat for the City Engineer. C. An agreement is required for maintenance of the rain gardens. d. Mill and overlay portions of Vicksburg Lane to avoid a seam running diagonally across the travel lanes. e. Provide cross sections for Vicksburg Lane showing how cross slopes and drainage will work. f. Check the sight distance at Vicksburg Lane and Terraceview. If it is not adequate, reconstruct a portion of Vicksburg Lane to provide it. g. Lengthen the turn lane and taper on Vicksburg Lane south of County Road 47 to provide 225' of turn lane stacking. h. Revise the striping and if necessary the pavement to provide a smoother travel path for the northbound thri lane on Vicksburg between Terraceview Lane and County Road 47. i. Provide pedestrian ramps for the sidewalks consistent with City Standard Plate STRT- 6. j. Provide concrete entrances for using City Detail STRT-13 for all commercial driveways. k. Extend the profile for County Road 47 at least 200 feet west of Vicksburg Lane. 1. Replace four foot gravel shoulder with four foot bituminous shoulder along Vicksburg Lane. M. Lengthen the left turn lane on southbound Vicksburg Lane at County Road 47 to provide at least an additional 100 feet of stacking. n. Provide a left turn lane on southbound Vicksburg Lane into the commercial entrance north of County Road 47. o. Use City detail STRT-5 for typical median nose. Resolution 2005-447 (2005045-F) Page 7 P. Extend sidewalk to concrete pedestrian ramp at Polaris and County Road 47. q. Add a vertical curve on County Road 47 station 145 + 55.46 to transition from the existing grade to the proposed grade. r. Check the sight distance for the Polaris Lane and 60"' Avenue intersection with 59"' Avenue. Change the profile if not adequate. S. Provide pedestrian ramps for the private trails consistent with City Standard Plate STRT-6. t. Check the sight distance for Shenandoah Lane at 55"' Avenue. Change the profile if not adequate. U. Revise Utility Note No. 13 on Page 21, to specify that fire hydrants shall be placed four feet behind the curb if located between the curb and sidewalk. V. Provide and show on the plans vehicle access to all sanitary manholes. W. Revise the trunk sanitary sewer to 16 inch diameter at a 0.2% grade from TI to T8. X. The watermain casing under County Road 47 at Juneau Lane shall be at a straight grade. Y. Show the sanitary sewer service riser between Manhole No. 77 and Manhole No. 78. Z. The 20" watermain installed in County Road 47 shall be open cut. A traffic control plan must be provided for this work. aa. Show access routes for all ponds complying with the current City of Plymouth Engineering Guidelines. bb. Easements must be provided for all temporary cul-de-sac turnarounds. cc. Driveway access must be maintained for the exception parcel. dd. The platted lots within the Taryn Hills plat shall vacate their rights to the private driveway access easement located north of County Road 47. ee. The developer is responsible to acquire any required temporary easements on adjacent property. ff. Provide signs at the north and south ends of Orchid Lane identifying the driveways as private. gg. Provide contours at least 100 feet beyond the north and east property lines. hh. It appears that significant runoff drains over the top of the retaining wall in the southeast corner of pond 5 TP. Demonstrate how the wall will be designed for this drainage. Resolution 2005-447 (2005045-F) Page 8 19. Standard Conditions: a. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. d. Street names shall comply with the City's street naming system. e. Any signage shall comply with the Sign Ordinance. f. The development shall comply with the Ordinance regarding turning radius, fire lane constriction, location of fire hydrants, lock boxes, post -indicator valves, fire department connections and fire lane signage. g. Prior to recording the final plat application, the developer shall receive City approval of the fire flow calculations. h. The multi -family strictures shall be protected by a City approved automatic fire sprinkler system. i. All street water mains shall be looped, and the water main system shall be looped for all cul-de-sac streets that exceed 500 feet in length. j. A reproducible 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees. k. Approval of this final plat shall expire two years from the date approved, unless the developer has recorded the final plat with Hennepin County, or unless prior to expiration, the developer submits a written request for an extension not to exceed one additional year, as regulated under Section 512 of City Code.
