RESOLUTION NO. 2005-434
REQUEST FOR PAYMENT NO. 2 AND FINAL
PINEVIEW RETAINING WALL PROJECT
CITY PROJECT NO. 5106
WHEREAS, the City of Plymouth as owner and Designing Nature, Inc. as contractor,
have entered into an agreement for the Pineview Retaining Wall Project, City Project No.
5106, said agreement was approved by the City Council on May 21, 2005; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $60,232.65 and the value of the
work to date is $60,163.65 and is herewith approved. This project is
below the original contract amount by 0.1%.
2. That the work performed by the contractor for the Pineview Retaining
Wall Project No. 5106 and certified to the Council by the engineer as
acceptable, being the same, is hereby released from the contract except as
to the conditions of the performance bond, any and all legal rights of the
owner, required guarantees and correction of faulty work after final
payment.
3. Request for Payment No. 2 and Final in the amount of $6,668.25 to
Designing Nature, Inc. for the Pineview Lane Retaining Wall Project No.
5106 is hereby approved and the City Finance Director is hereby
authorized and directed to pay the same forthwith.
