HomeMy WebLinkAboutCity Council Resolution 2005-425CITY OF PLYMOUTH RESOLUTION 2005-425 APPROVING A SITE PLAN AMENDMENT AND INTERIM USE PERMIT FOR OPUS NORTHWEST LLC, FOR AGA MEDICAL CORPORATION LOCATED AT 9700 SCHMIDT LAKE ROAD (2005110) WHEREAS, Opus Northwest LLC has requested approval of a site plan amendment and interim use permit for AGA Medical Corporation, located on property legally described as Lot 1, Block 1, and Outlot A, Northwestern Bell Plymouth Office I" Addition, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Opus Northwest LLC for a site plan amendment and interim use permit for property located at 9700 Schmidt Lake Road, subject to the following conditions: A site plan amendment to allow an 18,000 square foot building expansion and an interim use permit to allow reduced parking are hereby approved, in accordance with the plans received by the City on September 2, 2005, except as may be amended by this resolution. 2. The interim use permit for reduced parking allows 509 parking spaces where the Ordinance would require 565 spaces, based on the finding that the applicable interim use standards have been met. 3. The interim use permit for reduced parking shall expire if and when the City determines that there is a parking shortage on the site. At such time, the landowner shall obtain the appropriate approvals and constrict additional parking spaces on the site in compliance with the Zoning Ordinance requirement. Resolution 2005-425 (2005110) Page 2 4. The applicant must obtain the appropriate permits from the Building Division prior to commencement of the project. 5. Prior to issuance of building permits, the applicant shall submit the required Financial Guarantee and Site Performance Improvement Agreement. 6. Prior to issuance of building permits, the civil and architectural plans shall be signed by the appropriate licensed professional responsible for the plans. 7. Roof -top equipment shall be screened in compliance with the Zoning Ordinance. 8. Trash and recycling storage shall be in compliance with the Zoning Ordinance. 9. Prior to issuance of building permits, the following revisions shall be made to the plans: a. Indicate the size and type of material proposed in the utility systems on the utility plans. The new watermain shall be C900 PVC. b. 136-12 concrete curb and gutter is required for the parking lot. c. Minimum floor elevation shall be two feet higher than the 100 -year High Water Level of the pond. d. The site plan shall comply with the City of Plymouth's current Engineering Guidelines or the State Plumbing Code, whichever applies. e. Identify the High Water Level and Normal Water Level for the existing pond. f. Clearly label the watermain to be vacated, and identify how the new connection will be made. g. Provide City Details updated March 2005. h. Show location and use a Rock Constriction Entrance per City Detail DWG -9. i. Show location and use storm sewer catch basin protection both on and off site, per City Detail ST -22 and 23. j. Add note to the grading plan that all streets and parking areas shall be swept a minimum of once per week. k. Certain retaining walls require a building permit. See the Building Division to determine what is required for the proposed retaining walls. 10. A Transportation Demand Management (TDM) Program shall be submitted for staff review and approval prior to issuance of a certificate of occupancy for the proposed expansion. 11. Signage for the site shall be in compliance with the Sign Ordinance. Separate sign permits shall be required. 12. Any new lighting fixtures shall comply with the City's lighting regulations. 13. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. Resolution 2005-425 (2005110) Page 3 14. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 15. Standard Conditions: a. The applicant shall comply with the Ordinance regarding turning radii, and location of fire hydrants and fire lane signage. b. The building shall be protected bu a City approved NFPA 13 automatic fire sprinkler system. The fire sprinkler system shall be monitored by a UL central station, and shall have a UL certificate on the system. c. The applicant shall submit an 8 1/2 x 11 inch "As Built" Fire Protection Plan prior to the release or reduction of any site improvement financial guarantee. d. This site plan amendment approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
