HomeMy WebLinkAboutCity Council Resolution 2005-424CITY OF PLYMOUTH RESOLUTION 2005-424 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR EXECUTIVE HOMESITES, LLC. FOR "EXECUTIVE WOODLANDS", A SUBDIVISION OF 12 LOTS FOR SINGLE-FAMILY DWELLINGS LOCATED AT 405, 415, AND 425 HARBOR LANE NORTH (2005059F) WHEREAS, Executive Homesites, LLC. has requested approval of a final plat and development contract for Executive Woodlands, a plat of 12 lots for single-family dwellings on 6.19 acres located at 405, 415, and 425 Harbor Lane North; and WHEREAS, the property is legally described as follows: Lot 3, Block 1, Juneau Acres And, Lot 14, Block 2, Glen Grove Acres And, Lot 13, Block 2, Glen Grove Acres, all in Hennepin County, Minnesota WHEREAS, the City staf has prepared a development contract covering the improvements related to said plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Executive Homesites, LLC. for a final plat for Executive Woodlands, and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: Resolution 2005-424 Final Plat (2005059F) Page 2 1. Approval of the final plat is contingent upon the applicant executing the Development Contract. 2. This preliminary plat approves 12 single-family lots, in accordance with the plans received by the City on September 27, 2005, October 10, 2005, and November 4, 2005 except as amended by this Resolution. 3. This resolution waives the secondary access requirement because there are no locations available to provide a secondary access due to the existing homes that surround the site. 4. Prior to recording the final plat, the applicant shall revise the covenants/architectural controls for the neighborhood to include language stating that the homeowners shall be responsible for maintenance of the sidewalks, adjacent right(s)-of-way, monument signs, wetland buffers and buffer monuments to City standards on the subject property. 5. Prior to issuance of any permits, the applicant shall provide hydrologic calculations demonstrating that the runoff to the west is not increased. 6. Prior to issuance of a grading permit, the applicant shall demonstrate compliance with the City's Water Resources Plan policies, as follows: a. Describe how the constricted detention ponds would limit run-off to pre -development rates and to control downstream flooding where feasible. b. Describe how the increased volumes of runoff due to development will be minimized by limiting impervious cover and encouraging infiltration of storm water where soil conditions are appropriate and show how this is being done on the grading plan. c. Describe how the use of alternative landscape techniques and materials are reducing the rates and volumes of runoff and show how this is being done on the grading plan. d. Identify the steps the landowner will take to avoid water quality impacts and mitigate with appropriate best management practices (BMPs) to prevent water quality in receiving waters from falling below established standards and show how this is being done on the grading plan. 7. Prior to issuance of permits, the applicant shall revise the plans in conformance with the Engineering Guidelines and as follows: a. Revise the landscaping plan to 1) remove the symbols for the removed trees consistent with the tree preservation plan, and 2) relocate trees shown within the pond to conforming locations. The applicant may also consider planting larger trees to reduce the number of trees planted. b. Add a note to the grading plan that all disturbed areas within the wetland buffers shall be restored with an appropriate wetland buffer seed mix consistent with City requirements. c. Revise the grading plan to add one additional buffer post at the angle point on Lot 8 consistent with City requirements. d. Specify PVC watermain C900 (DR) 18. e. Show sanitary sewer risers in profile with length and stationing. Resolution 2005-424 Final Plat (2005059F) Page 3 f. Specify curb type and width of street. g. The watermain is required to be looped. This may require installation of a valve on the existing watermain. h. Clearly locate and label the existing services on the utility plan. Use existing services for Lots 1, 2, and 12 if possible, otherwise abandon. i. Show proposed grading for each lot consistent with City requirements. j. Show the installation of heavy duty silt fence around wetlands and project boundaries on the grading plan. k. Add standard seeding and erosion control notes on the grading plan. 1. Provide evidence that ground water from the bottom of the N [_]RP pond at elevation 981 will not cause ground water problems for the lowest floor elevation for Lot 10, and the home located south of the N [_]RP pond. m. Remove Detail "A" on page 3 of 6 and provide City detail ST -8 for storm sewer bedding. n. Tie all storm sewer joints from FES to the manhole and note on plan. o. Show the 1) storm sewer profile of N[_]RP pond outlet from existing storm manhole in Harbor Lane to pond FES and 2) all pipe crossings on the profile consistent with City requirements. p. Connections to the existing watermain must be a wet tap. q. Indicate the vertical separation between sewer pipes and the watermain shall not be less than 18 inches. r. Remove note on page 3 of 6 that states the draintile behind the curb is "not in this contract". Draintile is required behind the curb per City detail ST -9. s. Identify where private drain tile is required to be installed (grades of 1.75 percent and flatter). t. Revise storm sewer schedule using Neenah Casting R-2573 for CBMH 44A and Neenah Casting R -2561-A for CB 4 10 and 12. u. On the plat dedication page provide a signature line for the City Engineer. v. Relocate the light pole in the cul-de-sac to one of the Lot 8 property lines. w. Provide gutter grades in the cul-de-sac demonstrating at least a 0.5 % grade along the curb line. x. Lower the storm sewer line from CBMH 2 to CBMH 10 to get the bottom to 48" deep. y. Widen the emergency overflow to at least 20 feet at the 986 elevation. 8. Prior to recoding the final plat, the following easements are required: a. Standard drainage and utility easements (on the final plat): 1) a 10 -foot drainage and utility easement adjacent to all street right-of-ways, 2) a 6 -foot easement for all side and rear property lines, 3) a 20 -foot easement for all public utilities that are not located within the street right-of-way, and 4) an easement over all N [_]RP ponds and wetlands from the b. Access easements (separate documents): a 15 -foot access easement for maintenance to the N [_]RP pond, including all outlets and outfalls. The grade in the access area shall not exceed 15 percent and no plantings or other obstructions are permitted in the area. Resolution 2005-424 Final Plat (2005059F) Page 4 9. The developer shall obtain the necessary permits and approvals as follows: MPCA, NPDES and City of Plymouth right-of-way permit. 10. Prior to recording the final plat, the developer shall pay the park dedication fees, pursuant to City Code at the time the final plat is approved, for the total number of units shown on the plans. 11. Development standards shall be as required by the RSF-1 district. No variances are granted or implied. 12. Constriction of the pond shall not disturb the existing trees on the adjacent property without the owners' consent in writing. 13. Minimum flow elevations shall be at least two feet higher than the high water level for all lots that are adjacent to the N[_]RP pond, and both wetlands. Additionally, there must be a minimum of 18 inches of freeboard along emergency overflow routes to the lowest building opening. 14. Standard Conditions: a. All hazardous trees shall be removed from the property at the owner's expense. b. With the exception of one building permit for a model home, no building permits shall be issued until the final plat is filed and recorded with Hennepin County. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. No trees shall be planted within the public right-of-way, within 10 feet of a water, sewer, or stormsewer line. e. Signs shall require separate permits prior to installation. f. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the City to extend the expiration date, as regulated under Section 512 of City Code.
