HomeMy WebLinkAboutCity Council Resolution 2005-406CITY OF PLYMOUTH RESOLUTION 2005-406 REVISING CONDITION NO. 4 OF RESOLUTION 2001-256 AND APPROVING A PUD AMENDMENT FOR SWAN DEVELOPMENT, LLC. TO ALLOW THE CONSTRUCTION OF GARAGES IN EXCESS OF 1,000 SQUARE FEET FOR SINGLE-FAMILY HOMES IN THE SEVEN GREENS PUD LOCATED AT THE NORTHEAST CORNER OF SCHMIDT LAKE ROAD AND VICKSBURG LANE (2005107) WHEREAS, Swan Development, LLC. has requested approval of a PUD amendment to allow garages in excess of 1,000 square feet for single-family homes in the Seven Greens PUD for property legally described as follows: Lot 1, Block 1; Lots 1-4, Block 2; Lots 1-6, Block 3; Lots 1-5, Block 4; Lots 1-6, Block 5; Lots 1-3, Block 6; Lots 1-6, Block 7; Lot 1; Block 8; and Lots 7-10, Block 9, Seven Greens, Hennepin County, Minnesota; and, Lots 1-7, Block 1; Lots 1-2, Block 2; Lots 1-7, Block 3; Lots 1-5, Block 4; and Lots 1-13, Block 5, Seven Greens Second Addition, Hennepin County, Minnesota. WHEREAS, on June 26, 2001, the Plymouth City Council approved a PUD General Plan for Seven Greens which included 20 conditions; and, WHEREAS, Condition No. 4 of Resolution 2001-256 currently states "Development standards for the PUD shall be as indicated on the plans dated May 22, 2001, May 23, 2001, June 20, 2001 and June 21, 2001, except as amended by this resolution." And, WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Swan Resolution 2005-406 (2005107) Page 2 Development, LLC. to allow garages in excess of 1,000 square feet for single-family homes in the Seven Greens PUD, subject to the following conditions: 1. A PUD amendment is granted to allow garages in excess of 1,000 square feet for single-family homes in the Seven Greens PUD, in accordance with the application and plans received by the City on August 24, 2005, except as may be amended by this resolution. 2. All garages proposed in excess of 1,000 square feet shall have the area over 1,000 square feet provided in a lower level of a single-family home through the use of pre -stressed concrete constriction (or similar). Overhead garage doors shall not be visible from the front yard of the home and shall be a maximum of 9 feet in width. No driveway is permitted to the lower level garage. Garages in excess of 1,000 square feet on corner lots shall not have visibility from the yard containing the formal front entry into the home. 3. Building permits are required prior to the commencement of any constriction. ADOPTED by the City Council on October 25, 2005. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
