RESOLUTION 2005-392
APPROVING A CONDITIONAL USE PERMIT FOR OVER 50 PRECENT OFFICE USE
AND INTERIM USE PERMIT FOR REDUCED PARKING FOR WCL ASSOCIATES INC.,
FOR PROPERTY LOCATED AT 9600 -54TH AVENUE (2005102)
WHEREAS, WCL Associates, Inc. has requested approval of a conditional use permit and
interim use permit for property located at 9600 -54th Avenue, legally described as Lot 2, Block 1,
Loreli's Addition, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by WCL
Associates, Inc. for a conditional use permit and interim use permit for property located at 9600-
54th Avenue, subject to the following conditions:
1. The conditional use permit allows up to 95 percent office use and 5 percent warehouse use
for the 50,000 square foot building, in accordance with the application received by the City
on August 11, 2005, except as may be amended by this resolution.
2. The interim use permit allows reduced parking at the site, for as long as uninterrupted shuttle
service is provided to cover the parking shortage on the site.
3. The parking expansion at 4600 Nathan Lane shall be completed prior to the issuance of any
building permits to allow expansion of the office use beyond 50 percent for the building
located at 9600 -54th Avenue.
4. Any changes to this approval shall require Planning Commission and City Council
consideration.

5. If the shuttle service is discontinued or the City documents parking problems that cannot be
resolved, the City may take action to revoke both the conditional use permit and the interim
use permit.
6. The "No Parking" restriction on 54th Avenue shall be enforced.
7. This approval is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
8. This approval shall expire five years after the date of approval, unless the landowner or
applicant has substantially started constriction of the project, or unless the landowner or
applicant has received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Sections 21015.07 and 21020.04 of the Zoning Ordinance.
