RESOLUTION 2005-391
APPROVING A SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT, AND
VARIANCES FOR PROVIDENT/WATERFORD LLC, FOR "WATERFORD PLAZA
SHOPPING CENTER" TO ALLOW A NEW RETAIL BUILDING AND CHANGES TO THE
PARKING LOT AND SITE ACCESS, FOR PROPERTY LOCATED IN THE NORTHEAST
QUADRANT OF HIGHWAY 55 AND REVERE LANE (2005070)
WHEREAS, Provident/Waterford LLC has requested approval of a site plan amendment,
conditional use permit, and variances for Waterford Plaza Shopping Center, for property legally
described as follows:
Lot 1, Block 1, Waterford Park Plaza, according to the recorded plat thereof, and situate
in Hennepin County, Minnesota, together with the appurtenant easement(s) contained in
Document No. 5973332.
Part of the above property is registered land as evidenced by Certificate of Title No.
819415.
Note: The registered portion of the premises is described as follows:
That part of Lot 1, Block 1, Waterford Park Plaza embraced within the Southwest Quarter
of the Northeast Quarter of Section 36, Township 118, Range 22.
WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Provident/Waterford LLC for a site plan amendment, conditional use permit, and variances for
property located at 10100- and 10200 -6th Avenue, subject to the following conditions:

1. A site plan amendment, conditional use permit, and variances to allow improvements at the
Waterford Plaza Shopping Center are hereby approved, in accordance with the plans received
by the City on September 13, 2005, except as may be amended by this resolution.
2. A conditional use permit is approved to allow a third free-standing principal building on the
lot, based on the finding that the applicable conditional use permit standards have been met.
3. Variances are approved to allow a building setback of 35 feet from the front lot line along 6th
Avenue, and a parking setback of 6 feet from the new building, based on the finding that the
applicable variance standards have been met.
4. Other than the two variances specified in this resolution, no other variances are granted or
implied.
5. All signs shall require separate permits and shall be in conformance with the Zoning
Ordinance.
6. The electronic reader board shown on the proposed freestanding pylon sign is not presently
allowable, and therefore is not approved.
7. The two 75 square foot free-standing business signs shown on each side of the main site
entrance along 6t1' Avenue are not approved, and must be removed from the site plan prior to
issuance of any building permits.
8. Wall signage is allowed on two facades of the new retail building.
9. Any new lighting must comply with the City's lighting regulations.
10. The applicant shall enter into a development agreement with the City for the transportation
improvements required within the public right-of-way, and such improvements shall be
completed prior to any access changes for the site. The applicant shall be responsible for 100
percent of the costs of the transportation improvements.
11. Prior to issuance of building permits, the developer shall obtain the necessary permits and
approvals as follows: Bassett Creek Water Management Commission, NPDES, and City of
Plymouth Engineering Department for work in street right-of-way.
12. Sixth Avenue must remain open to traffic. Prior to issuance of building permits, the
developer shall submit a traffic control plan based on the MNMUTCD, to be used during
constriction.
13. Prior to issuance of building permits, the plans must be revised as follows:

a) If pipe spring line is less than 48 inches below finished grade, place granular material
under pipe to a minimum of 48 inches below finished grade. See detail ST -8 and
include on detail sheet.
b) Detail STRT-14 shall be used for all driveways. Include the detail on the detail sheet.
C) Include detail W-2 on the detail sheet.
d) Use C900 DR18 PVC Watermain in lieu of Ductile Iron Pipe.
e) Note that all Bolts, Nuts and Rodding shall be Stainless Steel.
f) Provide a storm sewer casting schedule using City standard castings.
g) On the utility plan remove Note 4 that states the watermain shall be poly wrapped.
h) The width of the driving lane of the current roundabout is shown as 25 feet, which
may appear as a two-lane roundabout to drivers. A 9 -foot trick apron delineated with
pavement markings, which would reduce the driving lane to 16 feet, shall be
constricted on the inside radius.
i) The existing lanes from the roundabout shall be increased to 15 feet from face -of -
curb to face -of -curb to accommodate larger vehicles.
j) Due to the proposed width of the northbound to eastbound right turn -lane at the
Revere Lane and 6th Avenue intersection to accommodate larger vehicles, pavement
striping is required on the east side of the pork -chop island to help guide passenger
cars through the turn.
k) Provide a no right turn sign on 6th Avenue at the northern driveway entrance.
1) Provide gutter and ground elevations for the turn lane from Revere Lane to 6th
Avenue demonstrating adequate drainage and include any necessary storm sewer
work.
m) B618 concrete curb and gutter is required for the turn lane from Revere Lane to 6th
Avenue.
n) Written permission for work on the adjacent property is required.
o) Core drill connections to existing catch basins.
14. Standard Conditions:
a. Prior to issuance of building permits, the applicant shall execute a Site Improvement
Performance Agreement (SIPA) and submit the required financial guarantees for the on-
site improvements.
b. The applicant shall comply with the Ordinance regarding the location of fire hydrants,
lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane
signage.
c. The applicant shall submit an 8 1/2 x 11 inch "As Built" Fire Protection Plan prior to the
release or reduction of any site improvement bonds per City Policy.
d. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.

e. The approval is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
f. This approval shall expire one year after the date of approval, unless the landowner or
applicant has substantially started constriction of the project, or unless the landowner or
applicant has received prior approval from the City to extend the expiration date for up to
one additional year, as regulated under Sections 21015.07, 21030.06, and 21045.09 of the
Zoning Ordinance.
