HomeMy WebLinkAboutCity Council Resolution 2005-381CITY OF PLYMOUTH RESOLUTION 2005-381 APPROVING A CONDITIONAL USE PERMIT TO ALLOW OPERATION OF KINDERGARTEN CLASSES FOR PROPERTY LOCATED AT 15870 46" AVENUE NORTH (2005098) WHEREAS, Ascension Evangelical Lutheran Church has requested approval of a conditional use permit to allow operation of a kindergarten classes for 20 children in the existing building on property legally described as follows: Lot 1, Block 1, Amhurst Sixth Addition, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Ascension Evangelical Lutheran Church for a conditional use permit for property located at 15870 46"' Avenue North, subject to the following conditions: 1. A conditional use permit to allow kindergarten classes for 20 children at 15870 46"' Avenue North is approved, in accordance with the application and plans received by the City on July 28, 2005, except as amended by this resolution. 2. A conditional use permit is approved to allow kindergarten classes on the subject property based on the finding that the seven conditional use permit standards have been met. 3. Compliance with all State of Minnesota educational facility requirements. 4. A separate building permit is required for re-classification of the occupancy. Constriction alterations may be required as determined at the time of building permit review. In addition, separate building permits are required for any interior building modifications. Resolution 2005-381 (2005098) Page 2 of 2 5. Signage shall comply with Section 21155 (Sign Regulations) of the Zoning Ordinance. 6. Standard Conditions: A. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. B. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. C. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
