HomeMy WebLinkAboutCity Council Resolution 2005-376CITY OF PLYMOUTH RESOLUTION 2005-376 APPROVING A SITE PLAN FOR CHARLES CUDD COMPANY FOR 28 TOWNHOUSES ON PROPERTY LOCATED AT 10 ZACHARY LANE (2005093) WHEREAS, Charles Cudd Company has requested approval of a site plan to allow the constriction of 28 townhouse units on the 23.4. -acre site located at 10 Zachary Lane, presently legally described as follows: That part of the South 48 rods (792 feet) of the Southwest Quarter of the Southwest Quarter of Section 36, Township 118, Range 22, Hennepin County Minnesota, lying north of the South 230 feet thereof and that part of the Southwest Quarter of the Southwest Quarter lying east of the West 349 feet thereof. Except roads. And, The West 349 feet of the South 230 feet of the Southwest Quarter of the Southwest Quarter of Section 36, Township 118, Range 22, Hennepin County Minnesota. Except roads. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Charles Cudd Company for a site plan to allow constriction of 28 townhouse units on the 23.43 -acre site located at 10 Zachary Lane, subject to the following conditions: 1. Approval of the site plan is contingent upon City approval of rezoning the site from RSF-I to RMF -2, the preliminary plat and wetland exemption. 2. The site plan is approved in accordance with the plans received by the City on July 15 and 21, 2005, and August 12 and 15, 2005 except as amended by this Resolution. Resolution 2005-376 File No. 2005033 Page 2 3. All development standards shall be as required by the RMF -2 zoning district. No variances are granted or implied. 4. Prior to issuance of building permits, the applicant must install the required permanent wetland buffer monuments pursuant to ordinance requirements. 5. Standard Conditions: a. All signage shall require separate permits and shall be in conformance with the Zoning Ordinance. b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
