RESOLUTION 2005-374
APPROVING FINDINGS OF FACT FOR THE REZONING OF LAND LOCATED AT 10
ZACHARY LANE (2005093)
WHEREAS, Charles Cudd Company, has requested reclassification of the zoning from RSF-1
(Single Family Detached 1) to RMF -2 (Multiple Family 2) for the 11.7 -acre parcel, legally
described as follows:
That part of the south 48 rods (792 feet) of the Southwest Quarter of the Southwest
Quarter of Section 36, Township 118, range 22, Hennepin County, Minnesota, lying
westerly of the following described line:
Commencing at the southwest corner of said Southwest Quarter of the Southwest
Quarter; thence on an assumed bearing of South 89 degrees 28 minutes 15 seconds East,
along the south line of said Southwest Quarter of the Southwest Quarter, a distance of
471.75 feet to the point of beginning of the line to be described: thence North 18 degrees
30 minutes 53 seconds East a distance of 333.76 feet; thence North 38 degrees 51 minutes
09 seconds West a distance of 182.07 feet; thence North 08 degrees 34 minutes 12
seconds West a distance of 273.40 feet; thence North 78 degrees 03 minutes 49 seconds
West a distance of 322.87 feet to the north line of said south 48 rods and said line there
terminating.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval; and
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from RSF-1
to RMF -2.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for
reclassification of the zoning from RSF-1 to RMF -2 for the for the western 11.7 -acres of the
property located at 10 Zachary Lane, based on the following findings:

1. The proposed RMF -2 zoning would provide a development that is consistent with the density
range of the LA -1 guiding.
2. The proposed townhouse development is compatible with the LA -1 guiding as the resource
preservation criteria is met.
3. The development would be consistent with the conclusions of the 2002 land use study.
4. There would be adequate transitions for the proposed development.
5. The development would meet or exceed the lot standards specified for the RMF -2 zoning
district.
6. Any changes to the infrastructure to support the RMF -2 zoning and the multi -family
development proposed for this site would be at the expense of the applicant.
