HomeMy WebLinkAboutCity Council Resolution 2005-368CITY OF PLYMOUTH RESOLUTION 2005-368 APPROVING A FINAL PLAT FOR HENRY LAZNIARZ FOR "SOUTH SHORE TRAIL", AN 18 -UNIT RESIDENTIAL CONDOMINIUM DEVELOPMENT TO BE LOCATED NORTH OF 11TH AVENUE AND WEST OF SOUTH SHORE DRIVE (2005007-F) WHEREAS, Henry Lazniarz has requested approval of a final plat for "South Shore Trail", a plat of one lot for 18 condominium units in one building on the 10.3 -acre site located north of 10' Avenue and west of South Shore Drive; and WHEREAS, the current legal description of the site is as follows: Commencing at intersection of the West line of the Northwest quarter and the South line of the Electric Shortline Railway right-of-way; thence East along said right-of-way to a point 50 rods West from its intersection with the West line of Medicine Lake Road; thence South and parallel with the West line of the Northwest quarter a distance of 16 rods; thence East at right angles to the center line of road; thence along said center line to a point 15.54 rods along same from the South line of said right-of-way; thence South along said center line to a point distant 30 rods North from the South line of the Northwest quarter of Northwest quarter; thence West parallel with the South line thereof to the West line of same; thence North to the point of beginning all in Section 36, Township 118, Range 22, Hennepin Co., Minnesota. Subject to restrictions, easements or right-of-ways of record. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Henry Lazniarz for a final plat for "South Shore Trail" for property located north of 11"' Avenue and west of South Shore Drive, subject to the following conditions: Resolution 2005-368 (2005007-F) Page 2 1. The final plat is approved in accordance with the plans received by the City on July 8, 2005, and application materials received by the City on August 25, 2005, except as may be amended by this resolution. 2. Development standards shall be as required by the RMF -4 district. No variances are granted or implied. 3. Prior to recording the final plat, the applicant shall pay all required park dedication fees pursuant to the ordinance in effect at the time the final plat is approved. 4. Prior to issuance of building permits, the applicant must install the required permanent wetland buffer monuments pursuant to ordinance requirements. 5. Prior to issuance of building permits, the applicant shall execute a Site Improvement Performance Agreement (SIPA) and submit the required financial guarantees. 6. Prior to issuance of building permits, the landscaping plan must be revised to replace the Sugar Maples with Red Maples. 7. Prior to issuance of building permits, the applicant shall revise the tree preservation plan to provide correct designations for all the trees, as identified by the City Forester. 8. The Homeowners Association shall be responsible for maintenance of the site, including the wetland buffers, monument signs, and similar features within the development. The Homeowners Association documents shall include language prohibiting storage in the parking spacesincluding storage of recreational vehicles. 9. Any signage shall require separate permits and shall be in conformance with the Zoning Ordinance. 10. A drainage and utility easement is required for the N [_JRP pond to the High Water Level. An unobstructed access easement is required to get to the N[_JRP pond from South Shore Drive. The access must be 15 feet wide and must not exceed a grade of 15 percent. Revise Landscaping Plan as necessary to provide for the access. 11. The developer shall obtain the necessary permits and approvals as follows: MPCA, Minnesota Department of Health, Bassett Creek Water Management Commission, NPDES, and City Street right-of-way permit. 12. The minimum floor elevation shall be 894.25 feet above sea -level. Resolution 2005-368 (2005007-F) Page 3 13. In conjunction with submission of the final plat application, the applicant shall revise the plans as follows: a. Use City Standard Details updated March 2005. b. Show Standard Details of ST -19 and ST -20 for storm sewer catch basin insert protection. Show location both on and off site. c. B-618 concrete curb and gutter is required for South Shore Drive. d. Show pedestrian ramp for the sidewalk at the driveway per City Detail STRT-6. e. Provide profile and edge of mat elevations along South Shore Drive a minimum of 100 feet both south and north of the plat boundary to show that the street drainage will work. f. Revise the plans so the end of the north radius of the north driveway lines up with the South Shore Drive curb line. Private drives shall have concrete aprons using City Detail STRT-13. g. The parking lot and garage drive shall have 20 foot radius. h. Specify that South Shore Drive must be patched with 4 inches of asphalt and 8 inches of class 5 aggregate or to match the existing cross section whichever is greater. Show and refer to City Detail STRT-2. i. Lower the N[_]RP pond emergency overflow from 893.25 to 892.75. j. Tie all storm sewer pipe joints from the manholes to the fixed end sections. k. Several storm sewer pipes and strictures are shallow. They shall be installed with granular material down to 48 inches below finished grade in accordance with City Detail ST -2. 1. Relocate south fire hydrant to the south property line. m. Relocate the north fire hydrant three feet south of the curb for the southerly parking drive aisle, and westerly to the west line of the 10 foot drainage and utility easement. n. Note on plans that watermain shall be PVC C900 with tracer wire. o. Note that silt fence shall be heavy duty with wire backing. p. Extend silt fence along south property line. q. Relocate the trees proposed along the south and east property lines outside the easement. 14. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valve, fire department connection, fire lanes, and fire lane signage. c. Prior to recording the final plat, the applicant shall submit fire flow calculations for approval by the Fire Inspector. d. The stricture shall be protected by a City approved, monitored, automatic fire sprinkler system. e. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees. Resolution 2005-368 (2005007-F) Page 4 f. A cross easement agreement with the property owners to the south of the site is required to ensure unobstructed fire access and water supply to the south side of the building. g. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. h. This approval shall expire two years after the date of approval, unless the property owner recorded the final plat, or unless the landowner or applicant has received prior approval from the City to extend the expiration date, as regulated under Section 512 of City Code.
