HomeMy WebLinkAboutCity Council Resolution 2005-363CITY OF PLYMOUTH RESOLUTION 2005-363 APPROVING SITE PLAN AND VARIANCES FOR MOHAGEN/HANSEN ARCHITECTURAL GROUP FOR "HIGHWAY 55 OFFICE CONDOMINIUMS" FOR PROPERTY LOCATED AT 18240 HIGHWAY 55 (2005086) WHEREAS, Mohagen/Hansen Architectural Group has requested approval of a site plan and variances to allow constriction of a three -unit office condominium building on the 0.83 -acre parcel located at 18240 Highway 55; and WHEREAS, the property is presently legally described as follows: Lot I and the northwesterly '/z of Lot 2, Block 1, Osier Addition, Hennepin County, Minnesota; also, All that part of the northwest quarter of the northeast quarter of Section 18, Township 118, Range 22 lying northeasterly of State Highway 55 as now laid out and traveled and lying northwesterly of Osier Addition. Subject to an easement over a 15.0 strip of land lying adjacent to said State Highway 55, to be used for a service road. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mohagen/Hansen Architectural Group for a site plan and variances for Highway 55 Office Condominiums for property located at 18240 Highway 55, subject to the following conditions: 1. Approval of the site plan and variances are contingent upon City approval of the preliminary plat. Resolution 2005-363 (2005086) Page 2 2. The site plan is approved in accordance with the plans received by the City on July 7, 2005, with preliminary plat received by the City on July 28, 2005, and with revised landscape plan received by the City on August 19, 2005, except as may be amended by this Resolution. 3. A variance is approved to allow a lot area of 0.83 acres, based upon the finding that the applicable variance standards have been met. 4. A variance is approved to allow a parking setback of 9.5 feet from the south lot line, based upon the finding that the applicable variance standards have been met. 5. Development standards shall be as required by the B -C district. No variances are granted or implied, unless specifically noted in this resolution. 6. Any signage shall require separate permits and shall be in conformance with the Zoning Ordinance. One freestanding sign is allowed on the site; not two as shown. 7. No medical/medical office uses (including dental and chiropractic uses) shall be permitted in any unit within the development. 8. Prior to the issuance of building permits, the applicant shall provide the City with a copy of the CIC (Common Interest Community) documents and any other related association documents for the development. The documents shall address maintenance of the common areas and the prohibition of medical/dental/chiropractic office uses within the project based on the City's parking requirement. 9. All waste and waste containers shall be stored within an enclosure stricture or inside the building. 10. No outside storage is allowed on the site. 11. The address of the site will change from Highway 55 to 45t11 Avenue. 12. The south access point must be removed when the 45'11 Avenue segment is constricted to the north lot line of the subject site. Prior to the issuance of building permits, revise the plans to how the south access point would be closed with the use of B612 curb and gutter in that area. 13. Prior to issuance of building permits, the developer shall provide cut sheets for the lighting fixtures that include house side shields. 14. Prior to issuance of building permits, the developer shall pay the outstanding watermain area assessments (0.8 acres x $3,275 per acre = $2,620). Resolution 2005-363 (2005086) Page 3 15. Prior to issuance of building permits, the applicant shall pay the outstanding sanitary sewer area assessments (0.8 acres x $880 per acre = $704). 16. Prior to recording the final plat, the applicant shall execute a Development Contract for the public and private improvements, and shall submit the required financial guarantees. 17. Utility and drainage easements must be provided as follows: ten -feet wide along 45t11 Avenue and along the south plat line adjacent to Highway 55, and six -feet wide along the other lot lines. 18. The existing 5 -foot wide utility and drainage easement that is located within the proposed plat must be vacated. 19. The minimum floor elevation shall be 1018.5 feet. 20. Prior to issuance of building permits, the following items must be completed: a. submission of a rain garden and retaining wall maintenance agreement. b. The developer shall obtain the necessary permits and approvals as follows: Mn/DOT, MPCA, Minnesota Department of Health, Elm Creek Water Management Commission, and NPDES. c. Written permission must be obtained from the adjacent property owner in order to grade off-site at the northwest corner of the plat. 21. Prior to issuance of building permits, the plans must be revised as follows: a. Show detail of pedestrian ramp per City Detail STRT-6. b. Show concrete apron at entrance off of 45'11 Avenue per City detail STRT-13. c. Show correct location of existing fire hydrant in the plat of Plymouth Office Plaza. d. Show proposed retaining wall materials. e. Show location of catch basin inlet protection both on and off site per City Details ST -22 and 23. Add to detail page. f. Extend silt fence across south plat line to include the rain garden outlet. g. Label all silt fences as (sf), not (cf). All silt fences shall be heavy duty with wire backing per City Detail DWG -9. h. Show a detail of the rain garden including cross section, area in square feet, outlet pipes, plant schedule and location. Plants shall be a minimum of 4 inch pots, or larger. i. Update City Detail pages to current revision date of March 2005. j. Provide the street grade including spot locations along the curb line showing how it fits with the adjacent property. At least a 20 foot radius is required for the inside radius of the street. Constriction of the inside radius is required. k. Provide a sanitary sewer stub to the east and verify that it is deep enough to serve all of the Osier Addition. Resolution 2005-363 (2005086) Page 4 1. Show fire hydrant and post indicator valve locations per direction from the fire inspector. m. Corrugated metal pipe is not allowed; change to reinforced concrete pipe. n. On page Al. 1, relocate proposed tree located at northeast corner of building so it is not on top of sewer and water services. o. Fabric must be placed behind the retaining wall. 22. Standard Conditions: a. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. b. Prior to the issuance of any building or utility permits, the applicant shall submit fire flow calculations in compliance with City Code and other applicable codes. c. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. d. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees per City Ordinance. e. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21030.06 and 21045.09 of the Zoning Ordinance.
