HomeMy WebLinkAboutCity Council Resolution 2005-359CITY OF PLYMOUTH RESOLUTION 2005-359 APPROVING SIGNAGE VARIANCE REQUEST FOR ICON IDENTITY SOLUTIONS FOR CVS PHARMACY LOCATED AT 4140 COUNTY ROAD 101 (2005060) WI-1EREAS, an application has been filed by ICON Identity Solutions which requests approval of a sign variance to allow signage on three walls of the CVS Pharmacy building, where the Zoning Ordinance allows signage on two walls, for property legally described as follows: Lots 1, 2, 3, and 4, Block 1, Hughston Addition, according to the recorded plat thereof, Hennepin County, Minnesota. That part of the North Half of the Southeast Quarter of the Northeast Quarter of Section 18, Township 118, Range 22, described as follows: Commencing at the intersection of the South boundary line of the North Half of the Southeast Quarter of Northeast Quarter of Section 18, Township 118, Range 22 and the Southwesterly boundary line of new State Highway Number 55; thence Northwesterly along said boundary line 231.25 feet; thence at an angle Southwesterly to a point on the East boundary line of Highway No. 101, 78.15 feet to a point 135.6 feet North of the intersection of the South boundary line of said North Half of the East boundary line of said Highway No. 101; thence South along highway line 135.6 feet; thence East to the point of beginning, according to the United States Government Survey thereof and situate in Hennepin County, Minnesota. WI-1EREAS, the Planning Commission has reviewed the request at a duly called public meeting. Resolution 2005-359 (2005060) Page 2 of 3 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by ICON Identity Solutions for a sign variance to allow signage on three walls of the CVS Pharmacy building located at 4140 County Road 101, subject to the following conditions: 1. This resolution approves a variance to allow signage on three walls of the CVS Pharmacy building in accordance with the plans and application received by the City on August 26, 2005 except as amended by this resolution. 2. The variance is approved with the finding that the applicable variance standards are met. Specifically: a) The triangular shape of the lot, together with the building orientation and layout of the surrounding road system, creates a hardship because, although the site has only two street frontages, it is fiilly visible from public roads on three sides. The north, west, and east walls all face toward a public road. b) The conditions relating to this site are not generally applicable to other property in the same zoning classification. c) The request is not based exclusively upon a desire to increase value or income potential. The proposed signage would aid westbound motorists on Highway 55 in recognizing the use, and allow the time needed to safely to get into the left lane of the highway as they approach the building. d) The conditions were created by the original platting of the land which dates back about 50 years, and the orientation/ layout of the surrounding road system. e) Granting of this variance would not be detrimental to the public welfare or injurious to other land or improvements in the area. Additionally, if the variance is approved, the applicant would remove some of the existing signage on the north and west walls of the building, which would result in fewer messages to confiise the traveling public. f) The proposed signage on a third wall would not impair an adequate supply of light and air to adjacent property, nor would it substantially increase the congestion of the public streets, increase the danger of fire, endanger the public safety, or substantially impair property values within the neighborhood. g) The requested variance is the minimum action required to eliminate the hardship. 3. Prior to installation of the new sign on the east wall, the applicant must first obtain the required sign permit. Resolution 2005-359 (2005060) Page 3 of 3 4. Prior to installation of the new wall sign on the east wall, the applicant must first remove existing signage on the north and west walls in accordance with the variance application and plans related to this approval. 5. Under this approval, the building may have 133 square feet of signage on the north wall, 133 square feet of signage on the west wall, and 74.8 square feet of signage on the east wall. In order for wall signage to be increased above these specified amounts at any time in the future, signage must be completely removed from one of these three walls. 4. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21030.06 of the Zoning Ordinance.
