HomeMy WebLinkAboutCity Council Resolution 2005-319CITY OF PLYMOUTH RESOLUTION 2005-319 APPROVING A SITE PLAN FOR LUNDGREN BROS. CONSTRUCTION, INC. FOR 306 COLONIAL MANNER TOWNHOME UNITS WITHIN THE "TARYN HILLS" DEVELOPMENT, FOR PROPERTY LOCATED SOUTHEAST OF COUNTY ROAD 47 AND VIICKSBURG LANE (2005045) WHEREAS, Lundgren Bros. Constriction, Inc. has requested approval of a site plan for the Colonial Manner townhome development within "Taryn Hills" to allow constriction of 306 townhome units in 33 buildings, for property located southeast of County Road 47 and Vicksburg Lane; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lundgren Bros. Constriction, Inc. for a site plan to allow constriction of 306 townhome units in 33 buildings, for property located southeast of County Road 47 and Vicksburg Lane, subject to the following conditions: 1. Approval of the site plan is contingent upon City approval of the rezoning of the site from FRD (Future Restricted Development) to RMF -3 (Multiple Family 3), and upon City approval of the preliminary plat. 2. The site plan is approved in accordance with the plans received by the City on June 29, 2005, except as may be amended by this resolution. 3. Development standards shall be as required by the RMF -3 zoning district. No variances are granted or implied. 4. Prior to issuance of building permits, the applicant shall install the required permanent wetland buffer monuments pursuant to ordinance requirements. In conjunction with submission of the first final plat application including this town home area, the applicant shall submit a lighting plan that complies with the City's lighting regulations. 6. Any signage shall require separate permits and shall be in conformance with the Zoning Ordinance. 7. The applicant shall revise the plans to address the requirements noted in the preliminary plat resolution approved for this development project. 8. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. c. In conjunction with submission of the final plat application, the applicant shall submit fire flow calculations. d. The stricture shall be protected by a City approved automatic fire sprinkler system. e. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees per City Ordinance. f. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
