HomeMy WebLinkAboutCity Council Resolution 2005-258CITY OF PLYMOUTH RESOLUTION 2005-258 APPROVING SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT TO ALLOW A CHURCH EXPANSION FOR BEAUTIFUL SAVIOR LUTHERAN CHURCH LOCATED AT 5005 NORTHWEST BOULEVARD (2005057) WHEREAS, Beautifiil Savior Lutheran Church has requested approval of a site plan amendment and conditional use permit for a 28,136 -square foot church expansion located at 5005 Northwest Boulevard, for property legally described as: That part of Outlot A, The Meadows of Bass Lake, according to the plat thereof of record in Hennepin County, Minnesota, which lies Westerly of Northwest Boulevard; the Westerly line of said Northwest Boulevard being described in Document No. 5934877 as follows: Beginning at the Southwest corner of said Outlot A; thence North 0 degrees 42 minutes 15 seconds West, assumed bearing along the West line of said Outlot A a distance of 578.67 feet; thence Northeasterly 243.17 feet along a nontangential curve concave to the East having a radius of 789.30 feet and a central angle of 17 degrees 39 minutes 06 seconds, the chord of said curve bears North 28 degrees 21 minutes 14 seconds East; thence North 37 degrees 10 minutes 47 seconds East, tangent to said curve 259.20 feet; thence Northeasterly 148.21 feet along a tangential curve concave to the Northwest having a radius of 689.30 feet and a central angle of 12 degrees 19 minutes I I seconds to the North line of said Outlot A and there terminating; Together with: The Southwest Quarter of the Northeast Quarter of Section 10, Township 118, Range 22, Hennepin County, Minnesota, except a strip of land 100 feet wide being 50 feet in width on each side of the center line of the Minneapolis, St. Paul and Sault St. Marie Railroad as it is constricted and laid out over and across said tract, and except Parcel 12 S.P. 2785 (494=393) 910; Resolution 2005-258 File No. 2005057 Page 2 Subject to Schmidt Lake Road as described in Document No. 5934877; to Medicine Lake Drive; and to all other matters of record. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Beautifiil Savior Lutheran Church for a site plan amendment to allow a 28,136 -square foot church expansion a and conditional use permit to allow a 62.5 -foot high church building and 80 -foot high church spire, subject to the following conditions: 1. site plan amendment to allow a 28,136 -square foot church expansion a and conditional use permit to allow a 62.5 -foot high church building and 80 -foot high church spire are approved in accordance with the application materials received by the City on May 12, 2005, and revised plans received by the City on June 17, 2005, except as amended by this resolution. 2. Prior to issuance of a building permit, a site improvement performance agreement and financial guarantee shall be submitted pursuant to Section 21045.10 of the Zoning Ordinance. 3. Prior to issuance of a building permit, a revised landscape plan shall be submitted showing 19 overstory trees (2.5 -inch for deciduous and 6 -feet for coniferous) to be planted on the subject property. The landscape plan shall show all proposed trees on the subject property. 4. Prior to issuance of a building permit, a revised lighting plan shall be submitted in compliance with Section 21105.06 of the Zoning Ordinance. In addition, house -side shields shall be added to all fixtures located within 300 feet of residential property, as required by the ordinance. The lighting plan shall be revised as necessary for all proposed lighting to be in compliance with ordinance requirements. 5. Engineering conditions: a. Prior to issuance of a building permit, the plans shall be revised to include the following: 1. Amend all standard details per the City's March 2005 guidelines. 2. Include ADA pedestrian ramp details STRT-6 and STRT-7. 3. Amend constriction note number 6 on the utility plan from Neenah R-3246 B to R- 3067 DL or DR type V. 4. Add a note on the plans to tie all pipe joints from CB 1 to the FES. 5. Relocate the hydrant gate valve three feet away from the hydrant per detail W-2. 6. Adjust grade on north side of proposed addition to a minimum of 1 3/4% grade. 7. Add City Details ST -22 and 23 for catch basin inlet protection and show the location on plans. Resolution 2005-258 File No. 2005057 Page 3 8. Show cross section of drive aisle and parking lot. Drive aisles shall be constricted to a minimum of a 7 ton design. Parking areas shall be designed to a minimum of a 5 ton design. 9. Submit a description on the grading plan of how increased volumes of runoff due to the proposed development would be minimized by limiting impervious cover and encouraging infiltration of storm water where soil conditions are appropriate. 10. Submit a description on the grading plan of how alternative landscape techniques and materials will reduce rates and volumes of runoff. 11. Identify on the grading plan all reasonable steps to avoid water quality impact and mitigate with appropriate best management practices (BMPs) to prevent water quality in receiving waters from falling below established standards. b. Prior to issuance of a building permit, a drainage and utility easement shall be submitted to the City for the NAW pond to the 100—year high water level. The drainage and utility easement for the NAW pond shall also be recorded at Hennepin County prior to any permit issuance. c. Prior to issuance of a building permit, hydrologic calculations shall be provided showing compliance with City water quality and quantity standards. Include a detail of the pond outlet stricture, stage/storage calculations for volumes below the outlet elevation, stage/storage calculations for volumes above the outlet elevation, and routings through the pond for the 1-, 2-, 5-, 10-, and 100 -year frequency storm events. d. Prior to issuance of a building permit, a Storm Water Pollution Prevention Plan (SWPPP) shall be provided, including all erosion control devices and seeding notes. e. Prior to issuance of a building permit, all appropriate permits shall be obtained from Hennepin County, Minnesota Department of Health, Shingle Creek Watershed Management Commission, and the NPDES. f. Prior to the financial guarantee being released, the City requires reproducible mylar prints of sanitary sewer, water service, storm sewer and pond As-Builts for the site. g. The site plan shall comply with the City of Plymouth's current Engineering Guidelines or the State Plumbing Code, whichever applies. h. The minimum floor elevation of the church expansion shall be 930 feet. 6. Fire Conditions: a. Prior to issuance of a building permit, the plans shall be revised to include the following: 1. Identify location of fire apparatus access road signage. 2. Identify relocated and added fire hydrants in locations approved by the City Fire Inspector. 3. Submit fire flow calculations flowing the remote two highest elevation hydrants simultaneously. Each hydrant shall be capable of flowing a minimum of 1,500 GPM at 20 PSI residual pressure. 4. All drive aisles shall be identified as fire lanes and constricted to minimum fire lane constriction requirements. All damaged fire lanes shall be repaired to a 7 -ton Resolution 2005-258 File No. 2005057 Page 4 driving capacity. Include fire lane sign locations and constriction details for the fire lane on the site plan. b. A complete loop of the watermain is required. c. The entire building shall be protected by a City approved NFPA 13 Automatic Fire sprinkler system. d. A building fire sprinkler system and fire alarm system shall be monitored by an approved LTL central station with a UL certificate on the system. The PIV and all system control valves with the system flow switches shall be monitored by the UL central station. e. An approved solenoid device is required to be connected between the building domestic water supply and the building fire sprinkler system. Activation of the fire sprinkler system shall shut off all domestic water on the site. f. Locate the Fire Department connection in an approved location on the south side of the building. g. An approved City of Plymouth Fire Department lockbox must be installed in an approved location near the main entry door on the south side of the building. h. An 8 1/2 inch x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement guarantees, per City Ordinance. i. Fire Lane signage must be installed in locations as identified by the Fire Inspector. j. The locations of post -indicator valves, and fire department connections shall be approved by the Fire Inspector. 13. Silt fence shall be installed prior to any constriction on the site. 14. Any rooftop equipment shall be screened or painted to match the building. 15. Standard Conditions: a. The applicant shall remove any diseased or hazardous trees. b. All signage shall comply with the Section 21155 of the Zoning Ordinance. c. Building permits are required prior to the commencement of any constriction related to the project. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21015.07 of the Zoning Ordinance.
