APPROVING A CONDITIONAL USE PERMIT TO ALLOW INSTALLATION OF A
75 -FOOT MONOPOLE WITH TELECOMM[_]NICATION ANTENNAS AND
RELATED EQUIPMENT FOR CINGULAR, WIRELESS PCS, INC. AT MESSIAH
UNITED METHODIST CHURCH, 17805 COUNTY ROAD 6. (2005037)
WHEREAS, Cingular Wireless PCS, Inc. has requested approval of a conditional use
permit for a 75 -foot high monopole tower to be located on the following described
property:
That part of the Southeast Quarter of the Southeast Quarter of Section 30,
Township 118 North, Range 22 West, which lies south of the centerline of County
Road No. 6, as now laid out and opened, which centerline is described as follows:
Beginning at the southeast corner of said Section 30; thence North along the east
line thereof, a distance of 1062.0 feet, to the actual point of beginning of the line to
be described; thence deflecting to the left at an angle of 86 degrees 31 minutes, a
distance of 1188.10 feet; thence deflecting to the left along a 3 degree curve, a
distance of 621.10 feet (delta angle of 18 degrees '18 minutes, tangent distance
313.30 feet): thence along tangent to the last mentioned curve to the west line of
Government Lot 4, in Section 30, and there terminating.
Described as follows:
Beginning at the intersection of the above described centerline of County Road
No. 6 with the west line of the Southeast Quarter of the Southeast Quarter of said
Section 30; thence easterly along said centerline to a point on said centerline which
point is 640.0 feet east of the west line of the Southeast Quarter of the Southeast
Quarter of said Section 30, as measured at right angles to said west line; thence
south and parallel to the west line of said Southeast Quarter of the Southeast
Quarter, a distance of 380.07 feet; thence northwesterly a distance of 640.75 feet
to a point on the west line of said Southeast Quarter of the Southeast Quarter,

which point is 380.01 feet south from the point of beginning; thence north along
said west line, a distance of 380.01 feet to the point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Cingular Wireless PCS, Inc. for a conditional use permit at Messiah United
Methodist Church, subject to the following conditions:
1. A conditional use permit is approved to allow a 75 -foot high monopole tower with
antennas and the related equipment, as shown on the application and plans received
by the City on April 12, 2005 and supplemental information received on April 29,
2005 and May 27, 2005, except as may be amended by this resolution.
2. The project requires a separate building permit prior to installation of the tower and
equipment.
3. Prior to issuance of a building permit, the applicant shall submit documents prepared
by a structural engineer demonstrating the tower is capable of supporting an
additional set of antennas.
4. Prior to issuance of a building permit, the applicant shall submit revised plans
showing one additional maple tree to be planted in a location to be agreed upon by
the church and the City.
5. All fencing shall conform to the requirements of the Zoning Ordinance. Separate
building permits are required for any fence proposed over six feet in height.
6. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
7. The monopole shall be painted a non -contrasting color or have a galvanized finish.
8. The conditional use permit shall expire one year from the date of approval, unless the
project is substantially completed or an extension is applied for and granted, as
regulated under Sections 21015.07 of the Zoning Ordinance.
