RESOLUTION 2005-249
APPROVING PUD AMENDMENT TO ALLOW CONSTRUCTUION OF A 3,547 -SQUARE FOOT
FREE-STANDING RESTAURANT BUILDING FOR PROPERTY LOCATED AT THE
NORTHEAST CORNER OF NORTHWEST BOULEVARD AND STATE HIGHWAY 55 (2005039)
WHEREAS, Frauenshuh Companies has requested approval of a PUD amendment to allow a 3,547 -
square foot restaurant building for property legally described as follows:
That part of Lot 4, Block 1, Northwest Business Campus 14'1'Addition, according to the recorded plat,
Hennepin County, Minnesota, lying southeasterly of the line described as follows:
Commencing at the northwest corner of said Lot 4; thence on an assumed bearing of South 59 degrees
34 minutes 00 seconds East, along the north line of said Lot 4, a distance of 187.64 feet to the point of
beginning of the line to be described; thence South 30 degrees 26 minutes 00 seconds West, a distance
of 348.00 feet to the south line of said Lot 4, and said line there terminating.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and
recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Frauenshuh
Companies to allow a 3,547 -square foot restaurant building to include a Jimmy John's sandwich shop
and a Starbucks coffee house at the northeast corner of Northwest Boulevard and State Highway 55,
subject to the following findings and conditions:
1. A PUD amendment is granted to allow a restaurant building for a 1,500 -square foot Jimmy John's
and an 1,800 -square for Starbucks, in accordance with the application and plans received by the City
on April 14, 2005, and revised plans received on June 16, 2005, except as may be amended by this
resolution.

2. With respect to the exterior building elevations for the planned Jimmy John's and Starbucks
building, the architectural details and color scheme shall be finalized with the PUD final plan. The
building materials will be required to match the existing building materials used in the adjacent
commercial portion of this PUD. In addition, the south elevation shall be revised to show uniform
architectural detailing of doors and windows. Furthermore, the rockcast block around the base of
the building shall be replaced with an approved material.
3. Prior to issuance of a building permit, the landowner shall obtain separate approval of a PUD final
plan for the respective restaurant building.
4. Prior to issuance of a building permit, cross easements for access, parking, and utilities shall be
revised to follow the proposed drive -aisles of the site. The revised easements shall be submitted for
approval by the City Engineer and shall subsequently be recorded prior to issuance of a building
permit.
5. Prior to issuance of a building permit, payment of the park dedication fee in lieu of land dedication
must be paid, based on the dedication ordinance in effect at the time the building permit is applied
for.
6. Prior to issuance of a building permit, a site improvement performance agreement and financial
guarantee shall be submitted pursuant to Section 21045.10 of the Zoning Ordinance.
7. Engineering conditions:
a. Prior to issuance of a building permit, the plans shall be revised to include the following:
1. Certificate of Survey and the site plan must be signed.
2. Approval from Bassett Creek Water Management Commission is required.

b. The lowest building opening shall be a minimum of 1 '/z feet higher than the emergency overflow
elevation.
8. Fire Conditions:
a. A City approved automatic fire sprinkler system is required to protect the entire building.
b. All drive aisles shall be identified as fire lanes and constricted to minimum fire lane constriction
requirements. All damaged fire lanes shall be repaired to a 7 ton driving capacity. Include the
fire lane sign locations and inside turn radius on all drive aisles from any direction on the plans.
c. An 8 1/2 inch x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or
reduction of any site improvement bonds, per City Policy.
d. Fire Lane signage must be installed in locations as identified by the Fire Inspector.
e. When an automatic fire extinguishing system is provided, the system shall be monitored by a UL
central station with a UL Certificate on the system. The PIV, all system control valves and the
system flow switches must be monitored by a UL central station.
f. The building domestic water and fire sprinkler combination water supply line must have a City
approved solenoid valve.

g. The locations of fire hydrants, post -indicator valves, and fire department connections shall be
approved by the Fire Inspector.
h. A City approved fire department lockbox is required at the main entry to the building.
9. Standard Conditions:
a. The applicant shall remove any diseased or hazardous trees.
b. All signage, including menu boards shall comply with the Section 21155 of the Zoning
Ordinance and approved sign plan for the Northwest Business Campus PUD.
c. All lighting shall comply with Section 21105.06 of the Zoning Ordinance.
d. All landscaping shall comply with Section 21130.03 of the Zoning Ordinance.
e. Building permits are required prior to the commencement of any constriction related to the
project.
f. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
g. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof
shall be grounds for revocation.
h. This approval shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project, or unless the landowner or
applicant has received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Sections 21045.09 and 21015.07 of the Zoning Ordinance.
