HomeMy WebLinkAboutCity Council Resolution 2005-247CITY OF PLYMOUTH RESOLUTION 2005-247 DENYING A VARIANCE TO ALLOW A DETACHED GARAGE IN A FRONT YARD FOR MARK WARREN FOR PROPERTY LOCATED AT 200 VICKSBURG LANE NORTH (2005043) WHEREAS, an application has been filed by Mark Warren which requests approval of a variance to permit a detached garage in a front yard for property legally described as follows: Lot 20, Block 2, Plymouth Manor 2"a Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request by Mark Warren for a variance to permit a detached garage in a front yard for property located at 200 Vicksburg Lane North, subject to the following findings: 1. There are no physical or topographical conditions on the property that require the applicant to build a 24 -foot by 24 -foot detached garage in the location proposed. The applicant could constrict a two -car garage on their property that would not require a variance. 2. The conditions upon which the variance request are based are not unique to this property. There are many residential properties in the RSF-I Zoning classification that front on two public streets. The home is also positioned 50 feet from the front property line along Vicksburg Lane. Since Vicksburg Lane is classified as an arterial roadway, the Zoning Ordinance requires a 50 -foot setback. Therefore, the home could not have been positioned differently to increase the side yard area of the property from what currently exists. In addition, the applicant could still constrict a two -car garage on the lot without the need for a variance. 3. The alleged hardship is not caused by this Chapter. Although the applicant may be inconvenienced by having to comply with the Zoning Ordinance requirement, there is no Resolution 2005-247 (2005043) Page 2 hardship. All residential properties within the City of Plymouth must comply with the same restriction. 4. The requested variance does not appear to be the minimum action required to eliminate the hardship because the applicant could constrict a garage of the same size in the same general location without a variance.
