RESOLUTION NO. 2005-245
APPROVING AN EXEMPTION AND
AUTHORIZING THE MAYOR TO SIGN THE
WETLAND CONSERVATION ACT
CERTIFICATE OF EXEMPTION FORM FOR
AVERY HOMES (2005003)
WHEREAS, Mr. Mike Avery, is requesting a wetland replacement exemption; and
WHEREAS, the wetland basin has been determined to be an incidental wetland basin; and
WHEREAS, the filling of these wetlands is exempt from the Minnesota Wetland Conservation
Act under riles 8420.0122. Subp. 5;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that the exemption is approved and the Mayor is authorized to
execute a Certificate of Exemption Form for Mr. Mike Avery, Avery Homes (2005003) for
property located at 9920 28"' Ave. N, PID 2411822420059..
