RESOLUTION 2005-241
REVISING AND REPLACING RESOLUTION 97-621 APPROVING A FINAL PLAT AND
DEVELOPMENT CONTRACT FOR U.S. HOME CORPORATION FOR PROPERTY
LOCATED NORTH OF ROCKFORD ROAD BETWEEN VICKSBURG LANE AND
DUNKIRK LANE (95139-17)
WHEREAS, U.S. Home Corporation has requested approval of a Final Plat for Westbranch 4th
Addition, containing roughly 14.8 acres located north of Rockford Road between Vicksburg
Lane and Dunkirk Lane; and
WHEREAS, the City staff has prepared a Development Contract covering the improvements
related to said plat.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat and
Development Contract for Westbranch 4th Addition for property located north of Rockford Road
between Vicksburg Lane and Dunkirk Lane; and,
FURTHER, that the Development Contract for said plat be approved, and that the Mayor and
City Manager be authorized to execute the Development Contract on behalf of the City; and,
FURTHER, that the following conditions be met prior to recording of, and related to said plat:
1. This Final Plat approval is for the creation of one single family lot, 22 twin home lots, and
one outlot for common open space in the area of the proposed twin homes, in accordance
with the plans received by the City on July 28, 1997, except as amended by this resolution.
2. Development standards shall be as specified by the RSF-4 zoning district.
3. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication
Policy in effect at the time of recording the Final Plat.

4. Prior to filing the Final Plat, the Utility Plan shall be revised to add and relocate fire hydrants
as approved by the Fire Inspector.
5. Prior to filing the Final Plat, fire flow calculations must be approved by the Fire Inspector.
6. Appropriate legal documents regarding Homeowners Association documents, covenants and
restriction as approved by the City Attorney shall be filed with the Final Plat.
7. The Homeowners Association documents shall include ownership and maintenance of Outlot
A.
8. Any signage shall comply with the Sign Ordinance.
9. A fence permit shall be obtained prior to constriction of the proposed fencing for the
southwest portion of the site.
10. The applicant shall establish a 15 -foot wide average buffer around the medium quality
wetland, and a 20 -foot wide average buffer around the high quality wetland.
11. Prior to the issuance of building permits, buffer monuments shall be placed in accordance
with Section 21670.07 of the Zoning Ordinance. The monument design shall be approved by
the Community Development Department.
12. Submission of the required Financial Guarantee and Site Improvement Performance
Agreement (SIPA) for completion of site improvements within twelve months of the date of
this resolution. The SIPA shall include, but not be limited to, the wetland buffer monuments
and signs, and the landscaping and fencing indicated on the July 28, 1997 plans.
13. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
c. No building permits shall be issued until a contract has been awarded for sewer and water.
d. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin
County.
e. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
strictures on sites adjacent to, or containing any open storm water drainage facility.
f. Street names shall comply with the City Street Naming System.
g. Private driveway access shall be limited to internal public roads and restricted from Dunkirk
Lane and Rockford Road.
h. Compliance with Policy Resolution 89-439 regarding Tree Preservation.
i. The Developer shall hold the City and its officers, employees, and agents harmless from
claims made by itself and third parties for damages sustained or costs incurred resulting from
plat approval and development. The Developer shall indemnify the City and its officers,

employees, and agents for all costs, damages, or expenses which the City may pay or incur in
consequence of such claims, including attorneys' fees.
14. Private drive access shall be restricted from the lot at 3800 Zaiizibar Lane North
Flock 1 Westbra��ch 4t1x Addition) to 38r1x Place North.
