HomeMy WebLinkAboutCity Council Resolution 2005-214CITY OF PLYMOUTH RESOLUTION 2005-214 APPROVING A SITE PLAN AMENDMENT AND INTERIM USE PERMIT FOR CONSTRUCTION CONSULTANTS, INC. AT THE FLUIDYNE AEROTEST LABORATORY LOCATED AT 13825 SCHMIDT LAKE ROAD (2005041) WHEREAS, Constriction Consultants, Inc. has requested approval of a site plan amendment and interim use permit for Fluidyne Aerotest Laboratory, located on property legally described as follows: Outlot A, SAVANNAH, Hennepin County, Minnesota and the west 430.00 feet of the north 1089.00 feet of the Northeast Quarter of the Southwest Quarter of Section 10, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Constriction Consultants, Inc. for a site plan amendment and interim use permit for property located at 13825 Schmidt Lake Road, subject to the following conditions: 1. Approval of the site plan and interim use permit is contingent upon City approval of the rezoning of the site to I-1 (Light Industrial). 2. A site plan amendment to allow a 5,000 square foot machine -shop addition and related improvements and an interim use permit to allow reduced parking are hereby approved, in accordance with the plans received by the City on April 14 and 25, 2005, except as may be amended by this resolution. 3. The interim use permit for reduced parking allows 40 parking spaces where the Ordinance would require 70 spaces, based on the finding that the applicable interim use standards have been met. Resolution 2005-214 (2005041) Page 2 4. The interim use permit for reduced parking shall expire if and when the City determines that there is a parking shortage on the site. At such time, the landowner shall constrict additional parking spaces on the site in compliance with the Zoning Ordinance requirement. 5. The applicant must obtain the appropriate permits from the Building Division prior to commencement of the project. 6. The addition to the building must be protected by a City approved automatic fire sprinkler system. 7. Prior to issuance of building permits, the applicant shall submit the required Financial Guarantee and Site Improvement Performance Agreement. 8. Prior to issuance of building permits, the applicant shall obtain the necessary permits as follows: Minnesota Department of Health, Shingle Creek Watershed Management Commission, and NPDES. Additionally, a street right-of-way permit from the City is required to core drill into the existing storm sewer catch basin in Schmidt Lake Road. 9. Prior to or concurrent with the issuance of other permits, the applicant shall secure a building permit for the constriction of an engineered retaining wall from the Building Department. A fence is required on top of the wall. 10. Prior to issuance of a building permit, the applicant shall submit fire flow calculations flowing the two remote highest elevation hydrants simultaneously. Each hydrant must flow a minimum of 1500 GPM at 20 PSI residual pressure. 11. Prior to issuance of a building permit, the plans shall be revised as follows: a. Add locations for fire lane signage. b. Show the fire Department connection in an approved location on the northeast corner of the north wall of the existing building and the Fire Department lockbox shall be installed in an approved location at the main entry area to the building. c. Demonstrate that the fire lane paving is designed to a minimum capacity of seven -tons and is a minimum of 20 feet wide. d. Provide B-612 curb and gutter adjacent to the west side of the new addition and landscaping area and as needed to direct stormwater to the proposed storm sewer manhole. e. The proposed bituminous noted on sheet C -I shall be 8" class 5 100% crushed rock, 2" bituminous base; MN/DOT spec 2360; 1-1/2" bituminous wear, MN/DOT spec 2360. f. Inlet protection is required for the catch basins, include Details ST -22 and ST -23 on detail sheet. g. Use March 2005 edition City of Plymouth standard details. Note on the plans current City of Plymouth Engineering Guidelines Shall Apply. Resolution 2005-214 (2005041) Page 3 h. Note the amount of disturbed area. i. Show heavy-duty silt fence on the grading plan for all disturbed areas. Use City Detail DWG -9 and include on the plans. j. Identify storm sewer pipe and type of casting. k. Provide positive drainage and show the proposed elevation of the overflow route on plans to avoid trapping storm water on driveways on the south side of the future building addition. 12. The lowest floor elevation must be two feet higher than the high water level elevation of the adjacent ponds/wetlands west of the project site. Lowest opening must be 1.5 feet above the emergency overland overflow route. 13. Prior to issuance of any permits, the applicant shall demonstrate compliance with the City's Water Resources Plan policies, as follows: a. Describe how the constricted detention ponds would limit run-off to pre -development rates and to control downstream flooding where feasible. b. Describe how the increased volumes of runoff due to development will be minimized by limiting impervious cover and encouraging infiltration of storm water where soil conditions are appropriate. c. Describe how the use of alternative landscape techniques and materials are reducing the rates and volumes of runoff d. Identify the steps the landowner will take to avoid water quality impacts and mitigate with appropriate best management practices (BMPs) to prevent water quality in receiving waters from falling below established standards. 14. The applicant shall submit an 8 1/2 x I I inch "As Built" Fire Protection Plan prior to the release or reduction of any site improvement financial guarantee. The City will also require reproducible mylar prints of sanitary sewer, water service, storm sewer and pond "As-Builts" for the site prior to the financial guarantee being released. 15. Street sweeping is required at least once per week throughout the constriction process. 16. Signage for the site shall be in compliance with the Sign Ordinance. Separate sign permits shall be required. 17. Roof -top equipment shall be screened in compliance with the Zoning Ordinance. 18. Trash and recycling storage shall be in compliance with the Zoning Ordinance. 19. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. Resolution 2005-214 (2005041) Page 4 20. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 21. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 of the Zoning Ordinance.
