HomeMy WebLinkAboutCity Council Resolution 2005-211CITY OF PLYMOUTH RESOLUTION 2005-211 APPROVING AN INTERIM HOME OCCUPATION LICENSE FOR MARY SCHABEL FOR PROPERTY LOCATED AT 17410 -9TH AVENUE NORTH (2005044) WHEREAS, Mary Schabel has requested an interim home occupation license to operate a massage therapy business from her home at 17410-Wh Avenue North, legally described as follows: Lot 23, Block 1, City View Acres, 2"a Unit, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mary Schabel for an interim home occupation license at 17410-9"' Avenue North, subject to the following conditions: 1. The interim home occupation license is approved for a massage therapy business in accordance with the application and plans received by the City on April 20, 2005 except as amended by this resolution. 2. Compliance with Section 21145 of the Zoning Ordinance, relating to Home Occupations. 3. The interim home occupation license is valid for one year from the date of approval. The applicant may apply to the Zoning Administrator for renewal of the interim home occupation prior to expiration of the license. 4. The applicant must retain a serperate license from the City of Plymouth to operate a Massage Therapy Business. Resolution 2005-211 2005044 Page 2 5. Staff finds that the applicant meets all the general standards for home occupations and all the specific requirements for interim home occupations. Specifically, staff finds: a) The home occupation would be clearly incidental and secondary to the residential use of the premises, would not change the residential character, and would not result in a disturbance to the surrounding uses. b) On -street parking facilities would not be used to accommodate parking demand. c) Less than 25 percent of one story of the home would be used for the home occupation. d) No person other than those who reside in the home would be employed on the premises. e) No more than 10 client appointments are allowed per day.
