HomeMy WebLinkAboutCity Council Resolution 2005-174CITY OF PLYMOUTH RESOLUTION 2005-174 APPROVING SITE PLAN AMENDMENT AND VARIANCES FOR THE CITY OF PLYMOUTH TO ALLOW RECONSTRUCTION OF THE BASS LAKE LIFT STATION (SANITARY SEWER LIFT STATION NO. 5), LOCATED AT 12001-54t" AVENUE NORTH (2005022) WHEREAS, the City of Plymouth has requested approval of a site plan amendment and setback variances to allow reconstruction of the Bass Lake Lift Station located at 12001- 54"' Avenue North; and, WHEREAS, the property is legally described as follows: Outlot A, Larch Heights Lagoon 2"a Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the site plan amendment and variances to allow reconstruction of the Bass Lake Lift Station located at 12001-54"' Avenue North, subject to the following conditions: 1. This resolution approves the reconstruction of a sanitary sewer lift station, in accordance with the plans received by the City on April 5, 2005, except as may be amended by this resolution. 2. This resolution approves setback variances of 0 feet to the front lot line and 14 feet to the ordinary high water elevation for the lagoon to the south, based upon the following findings: Resolution 2005-174 (2005022) Page 2 a) The size, shape, and shallow depth (ranging from 20 to 35 feet) of this parcel creates a hardship, because without the variances, the lift station could not be reconstructed on the site. Additionally, the requested variances would provide for essential services for the benefit of the community and would allow for reasonable use of the land. b) The specific conditions and circumstances related to this parcel and request are not generally applicable to other properties in the RSF-1 district. c) The request is not based exclusively upon a desire to increase value or income potential of the property, but rather to allow reconstruction of an existing sanitary sewer lift station. d) The site conditions relating to the need for the variances were not created by the landowner. e) Granting the variances would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. The lift station buildings would be constricted to be compatible with the character of the surrounding development. In addition, the lift station would provide an essential public service. f) The granting of the variances would not impair an adequate supply of light or air to adjacent properties, nor would it substantially increase congestion in the public streets, increase the danger of fire, endanger the public safety, or substantially diminish or impair property values within the neighborhood. g) The requested variances are the minimum action required to eliminate the hardship. 3. The appropriate building permits must be obtained prior to constriction of the building. 4. Native vegetation shall be planted in the area between the buildings and the lagoon. 5. On plan sheet G-2, change note 17 to read "All work shall be in accordance with the City Of Plymouth's current Engineering Guidelines". 6. Heavy duty silt fence is required on the south side of the project. 7. Show catch basin inlet protection per City Detail ST -22 and ST -23 dated March, 2005. 8. Show placement of rock constriction entrance. Resolution 2005-174 (2005022) Page 3 9. Add note to replace street cross section, curb and gutter with in-kind material. 10. Add note that stainless steel bolts, nuts, and rodding are required for all underground fittings. 11. Consider using C905 PVC instead of DIP for the 16 -inch watermain outside of the building. 12. Provide traffic control plan. One lane must remain open at all times. 13. Submit four copies of the General and Civil plans that are 24"x36". 14. Show first floor elevation of proposed buildings and high water level of Bass Lake on the grading plan. 15. A permit is required to work in the street right-of-way from the Engineering Department. 16. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
