HomeMy WebLinkAboutCity Council Resolution 2005-168CITY OF PLYMOUTH RESOLUTION NO. 2005-168 AUTHORIZING THE VACATION OF A PLATTED POND EASEMENT WITHIN PROVIDENCE ACADEMY WHEREAS, a public hearing with respect to said vacation was scheduled for April 26, 2005 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of April 26, 2005; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on April 26, 2005 to inform any and all interested parties relevant to the vacation of the platted pond easement in Providence Academy Addition; and WHEREAS, it was determined by the City Council that said easement was not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following pond easement be vacated: That part of Lot 1, Block 1, PROVIDENCE ACADEMY, Hennepin County, Minnesota, described as follows: Commencing at the most northerly corner of said Lot 1; thence South 57 degrees 20 minutes 05 seconds East, assumed bearing, along the north line of said Lot 1, a distance of 58.99 feet; thence South 58 degrees 30 minutes 49 seconds East a distance of 177.03 feet: thence South 34 degrees 17 minutes 57 seconds West a distance of 134.00 feet to the point of beginning of the land to be Resolution No. 2005-168 Page 2 described; thence North 34 degrees 17 minutes 57 seconds East a distance of 83.35 feet; thence South 63 degrees 00 minutes 29 seconds East a distance of 147.90 feet; thence South 53 degrees 03 minutes 15 seconds West a distance of 41.88 feet; thence South 29 degrees 22 minutes 28 seconds West a distance of 31.66 feet; thence South 14 degrees 40 minutes 26 seconds West a distance of 38.14 feet; thence North 40 degrees 51 minutes 37 seconds West a distance of 63.36 feet; thence North 63 degrees 01 minutes 40 seconds West a distance of 88.24 feet to said point of beginning. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
