HomeMy WebLinkAboutCity Council Resolution 2005-156CITY OF PLYMOUTH RESOLUTION 2005-156 APPROVING A PLANNED UNIT DEVELOPMENT (PUD) GENERAL PLAN FOR THE PLYMOUTH HOUSING AND REDEVELOPMENT AUTHORITY FOR A 96 -UNIT SENIOR APARTMENT BUILDING, FOR PROPERTY LOCATED NORTHWEST OF THE INTERSECTION OF VICKSBURG LANE AND MEDINA ROAD (2005014) WHEREAS, the Plymouth Housing and Redevelopment Authority (HRA) has requested approval of a PUD General Plan to allow constriction of 96 -unit senior apartment building on the 4.8 -acre site located northwest of the intersection of Vicksburg Lane and Medina Road, legally described as Lot 6, Block 1, Shops at Plymouth Creek; and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by the Plymouth HRA for a PUD General Plan to allow constriction of a 96 -unit senior apartment building on the 4.8 -acre site located northwest of the intersection of Vicksburg Lane and Medina Road, subject to the following conditions: The PUD General Plan is approved in accordance with the plans received by the City on March 4, 2005, except as may be amended by this Resolution. 2. Development standards shall be as shown on the PUD General Plan. 3. Park dedication fees were paid on the acreage of this site in 1982, based on the former industrial use. Conversion of the site from industrial use to residential use requires additional park dedication fees, based upon the incremental increase in park needs for dwelling units. Prior to issuance of the building permit, the applicant shall pay the required park dedication fee in the amount of $44,200. Resolution 2005-156 File No. 2005014 Page 2 4. Luminaires located within 300 feet of residential property shall be equipped with house side shielding. 5. Prior to issuance of the building permit, staff approval of the final lighting plan shall be required. 6. Any signage shall require separate permits and shall be in conformance with the Zoning Ordinance. 7. Prior to issuance of building permits, the applicant shall pay the outstanding watermain area assessments (estimated at $40,606). 8. Prior to issuance of building permits, the applicant shall pay the outstanding sanitary sewer area assessments (estimated at $8,096). 9. The applicant shall obtain the necessary permits and approvals as follows: MPCA, Minnesota Department of Health, Minnehaha Creek Water Management District, and NPDES. 10. The lowest floor elevation shall be at least two feet above the high water level of the adjacent N [_]RP pond. Additionally, there must be a minimum of 1.5 feet of emergency overland freeboard from the lowest building opening. 11. In conjunction with submission of the PUD final plan application, the applicant shall revise the plans as follows: a. PVC pipe shall be shown for all watermain. b. Wet tap 10 -inch watermain, or install 10"x 10" Tee and gate valve during utility constriction of Shops At Plymouth Creek. c. Sanitary sewer manhole could be installed during utility constriction of Shops At Plymouth Creek. d. Note storm sewer casting type on the utility plan. e. Tie all joints from STMH-2 to FES -1 at N[_]RP pond. f. The STMH-2 casting must be at least 1.5 feet higher than the pond overflow elevation. g. Hydraulically disconnect STMH-2 from the trench drain at the entrance to the underground parking area, to prevent backflow. h. Raise the high point in the driveway to the parking garage to elevation 1008.12, or 1.5 feet above the pond overflow elevation, whichever is higher. i. The area west of the parking garage driveway must be graded to 1.5 feet above the pond overflow elevation. Add spot elevations or notes to the grading plan to this effect. j. Add two catch basins over the proposed storm sewer line, as follows: 1) at west side of easterly drive entrance, and 2) at easterly side of westerly drive entrance. k. Show proposed elevations, not xxx.xx. 1. Add riprap per City standards for FES -1. Resolution 2005-156 File No. 2005014 Page 3 m. Add catch basin protection per City detail ST -19 and ST -20 (renumbered for 2005 as ST - 22 and ST -23). n. On page C3, revise General Utility Note F-4 to indicate that PVC watermain shall be used. Polly wrap is not required. o. On page C3, revise General Utility Note G-2 to indicate that PVC watermain shall be used. p. Label Vicksburg Lane on all plans that apply. q. Show drainage arrows on grading plan. r. Indicate all slopes 3:1 and greater. Show erosion control blanket for these slopes on the plan. s. Use heavy duty silt fence. t. Add note to plan that street sweeping is required a minimum of one time per week, or more as necessary. u. A separate Surface Water Pollution Prevention Plan is required. v. On page C-4 under Grading Notes letter L, remove "but not limited to staked straw bales and/or". w. Remove rock catch basin inlet protection from page C-5. x. Show 15 -foot wide access to N[_]RP pond and outlet stricture. The grade must not exceed 15 percent. No plantings are allowed in this area. y. Keep trees at least ten feet from each side of all underground pipes. 12. This resolution approves a variance to the Fire Code requirement for a fire lane within 50 feet of all sides of the building. 13. Standard Conditions: a. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. b. The stricture shall be protected by a City approved, monitored, automatic fire sprinkler system. c. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted upon project completion. d. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility.
