HomeMy WebLinkAboutCity Council Resolution 2005-118CITY OF PLYMOUTH RESOLUTION 2005-118 APPROVING A CONDITIONAL USE PERMIT FOR MARTIN LEEPER TO ALLOW AN ATTACHED GARAGE CONTAINING OVER 1,000 SQUARE FEET FOR PROPERTY LOCATED AT 5525 JUNEAU LANE NORTH (2005009) WHEREAS, Martin Leeper have requested a conditional use permit to allow an attached garage containing 2,176 square feet in gross floor area on property legally described as follows: The north 288.50 feet of Tract A, Registered Land Survey No. 1618, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Martin Leeper for a conditional use permit, subject to the following conditions: 1. A conditional use permit is approved to allow an attached garage containing 2,176 sqaure feet in gross floor area, as shown on the application and plans received by the City on January 26, 2005, except as may be amended by this resolution. 2. The total impervious surface coverage for this lot shall not exceed 25 percent, in compliance with the shoreland overlay district regulations for Pomerleau Lake. 3. Prior to constriction of the stricture, the applicant must obtain separate approval of a building permit. 4. Prior to issuance of a building permit, the applicant shall submit a copy of an on-site sewage treatment system permit application issued by Hennepin County. Resolution 2005-118 (2005009) Page 2 5. Standard Conditions: A. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. B. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. C. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
