HomeMy WebLinkAboutCity Council Resolution 2005-117CITY OF PLYMOUTH RESOLUTION 2005-117 APPROVING A SITE PLAN AMENDMENT FOR TIBURON HOMEOWNER'S ASSOCIATION FOR PROPERTY LOCATED AT 3399 PILGRIM LANE NORTH (2005012) WHEREAS, Tiburon Homeowner's Association has requested approval of a site plan amendment to allow constriction of a 26 -foot by 38 -foot accessory building on property legally described as follows: That part of Lot 85, Block 1, Tiburon, lying in the Southeast '/4 of the Northeast '/4 of the Northwest '/4 and in the South '/2 of North '/z of Section 24, T 118 R 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Tiburon Homeowner's Association for a site plan amendment to allow constriction of a 26 -foot by 38 - foot accessory building to store ground care equipment for property located at 3399 Pilgrim Lane North, subject to the following conditions: I. The site plan amendment allows constriction of a 988 -square foot (26 -foot by 38 -foot) accessory building in the central portion of the Tiburon Homeowner's Association property, pursuant to the application and plans received by the City on February 10, 2005, and revised plans received on March 4, 2005 and March 10, 2005, except as may be amended by this resolution. 2. Prior to constriction of the accessory building, the applicant shall obtain all appropriate building permits. Resolution 2005-117 (2005012) Page 2 of 2 3. The materials and colors of the building shall be compatible with the existing clubhouse building, including vinyl siding and a shingled roof. 4. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. a. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. b. This approval shall expire one year after the date of approval, unless the landowner has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance ADOPTED by the City Council on March 29, 2005.
