HomeMy WebLinkAboutCity Council Resolution 2005-114CITY OF PLYMOUTH RESOLUTION 2005-114 APPROVING A PRELIMINARY PLAT FOR HENRY LAZNIARZ FOR "SOUTH SHORE PARK", AN 18 -UNIT RESIDENTIAL CONDOMINIUM DEVELOPMENT TO BE LOCATED NORTH OF 11TH AVENUE AND WEST OF SOUTH SHORE DRIVE (2005007) WHEREAS, Henry Lazniarz has requested approval of a preliminary plat for "South Shore Park", a plat of one lot for 18 condominium units in one building on the 10.3 -acre site located north of 11"' Avenue and west of South Shore Drive; and WHEREAS, the property is presently legally described as follows: Commencing at intersection of the West line of the Northwest quarter and the South line of the Electric Shortline Railway right-of-way; thence East along said right-of-way to a point 50 rods West from its intersection with the West line of Medicine Lake Road; thence South and parallel with the West line of the Northwest quarter a distance of 16 rods; thence East at right angles to the center line of road; thence along said center line to a point 15.54 rods along same from the South line of said right-of-way; thence South along said center line to a point distant 30 rods North from the South line of the Northwest quarter of Northwest quarter; thence West parallel with the South line thereof to the West line of same; thence North to the point of beginning all in Section 36, Township 118, Range 22, Hennepin Co., Minnesota. Subject to restrictions, easements or right-of-ways of record. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Henry Lazniarz for a preliminary plat for "South Shore Park" subject to the following conditions: Resolution 2005-114 File No. 2005007 Preliminary Plat Page 2 1. Approval of the preliminary plat is contingent upon City approval of the rezoning of the site from RMF -2 (Multiple Family 2) to RMF -4 (Multiple Family 4). 2. The preliminary plat is approved in accordance with the plans received by the City on February 17, 2005, except as may be amended by this Resolution. 3. Development standards shall be as required by the RMF -4 district. No variances are granted or implied. 4. Prior to recording the final plat, the applicant shall pay all required park dedication fees pursuant to the ordinance in effect at the time the final plat is approved. 5. Prior to recording the final plat, the applicant shall pay the assessment for the fi ture street reconstruction cost of one-half of South Shore Drive (estimated at 513.06 feet x $90.51 per foot = $46,437.06). 6. Prior to issuance of building permits, the applicant must install the required permanent wetland buffer monuments pursuant to ordinance requirements. 7. Prior to issuance of building permits, the applicant shall pay the outstanding watermain area assessments (estimated at 18 units x $790.00 = $14,220). 8. Prior to issuance of building permits, the applicant shall execute a Site Improvement Performance Agreement (SIPA) and submit the required financial guarantees. 9. In conjunction with submission of the final plat application, the applicant shall revise the buffer and buffer setback on all the plans, in order to provide the required 15 -foot stricture setback from balconies not shown on the site plan, but shown on the building elevations. 10. In conjunction with submission of the final plat application, the applicant shall provide the City with a landscaping plan showing locations where four trees would be planted on or adjacent to the site, as approved by the City Forester. 11. In conjunction with submission of the final plat application, the applicant shall revise the tree preservation plan to provide correct designations for all the trees, pursuant to the City Forester's review comments dated February 18, 2005. 12. In conjunction with submission of the final plat application, the applicant shall provide the City with copies of the homeowner's association (HOA) documents for the development. 13. The HOA shall be responsible for maintenance of the site, including the wetland, wetland buffers, monument signs, and similar features within the development. The HOA documents Resolution 2005-114 File No. 2005007 Preliminary Plat Page 3 shall include language prohibiting storage in the parking spacesincluding storage of recreational vehicles. 14. Any signage shall require separate permits and shall be in conformance with the Zoning Ordinance. 15. A drainage and utility easement is required for the N [_]RP pond to the High Water Level. An access easement is required to get to the N [_]RP pond. The access must be 15 feet wide and must not exceed a grade of 15 percent. 16. The developer shall obtain the necessary permits and approvals as follows: MPCA, Minnesota Department of Health, Bassett Creek Water Management Commission, NPDES, and City Street right-of-way permit. 17. The contractor shall contact Sewer and Water Supervisor Brian Young at (763) 509-5992 at least 24 hours prior to any public sewer/watermain connection. 18. The contractor shall contact Street Supervisor Gary Smith at (763) 509-5993 at least 24 hours prior to any constriction activity within City right-of-way and/or easements. 19. The minimum floor elevation shall be 894.25 feet above sea -level. 20. In conjunction with submission of the final plat application, the applicant shall revise the plans as follows: a. Provide hydrologic calculations for the 1-, 2-, 10-, 50-, and 100 -year rain events. Include area drainage map. b. Show Standard Details of ST -19 and ST -20 for storm sewer catch basin insert protection. Show location both on and off site. c. Add a note to the grading plan that the street and parking lot must be swept a minimum of once per week during constriction (City Code 526.03, Subd. 3). d. Align the building and parking lot driveways to intersect South Shore Drive at 90 degrees. e. B-618 concrete curb and gutter is required for South Shore Drive, and B-412 concrete curb and gutter is required for the parking lot and both driveways. f. Provide profile and edge of mat elevations along South Shore Drive a minimum of 100 feet both south and north of the plat boundary. g. Provide a minimum of 1 3/4 percent grade for the swale on south side of building as graded westerly to N [_]RP pond. h. Show private drive details STRT-5 and STRT-5A. Label locations on plan for both building, and parking entrances. i. Relocate watermain wet tap 10 feet north of the south property line. Resolution 2005-114 File No. 2005007 Preliminary Plat Page 4 j. Place a note on the Utility Plan that reads "utility installation per City of Plymouth Engineering Guidelines is required". k. Provide a note that all storm sewer less than 4 feet deep must have granular material down to 48 inches below finished grade. 1. Eliminate the low area between the driveways. m. Add storm sewer inlets to building drive entrance that is located more than 10 feet west of street right of way. Connect the inlets to the parking lot storm sewer. n. On the grading plan, show filter fabric and rip rap on the overflow for the N [_]RP pond. o. Show detail of City approved skimmer stricture for N [_]RP pond outlet. p. Align the north radius of the north driveway with the south radius and end the curb at the end radius. q. Specify that South Shore Drive must be patched with 4 inches of asphalt and 8 inches of class 5 aggregate or to match the existing cross section whichever is greater. 21. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. c. In conjunction with submission of the final plat application, the applicant shall submit fire flow calculations. d. The stricture shall be protected by a City approved, monitored, automatic fire sprinkler system. e. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees. f. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 510 of City Code.
