RESOLUTION 2005-113
APPROVING FINDINGS OF FACT FOR THE REZONING OF PROPERTY LOCATED
NORTH OF I ITH AVENUE AND WEST OF SOUTH SHORE DRIVE (2005007)
WHEREAS, Henry Lazniarz has requested reclassification of the zoning from RMF -2 (Multiple
Family 2) to RMF -4 (Multiple Family 4) for the 10.3 -acre parcel located north of 11"' Avenue and
west of South Shore Drive, presently legally described as follows:
Commencing at intersection of the West line of the Northwest quarter and the South line
of the Electric Shortline Railway right-of-way; thence East along said right-of-way to a
point 50 rods West from its intersection with the West line of Medicine Lake Road; thence
South and parallel with the West line of the Northwest quarter a distance of 16 rods;
thence East at right angles to the center line of road; thence along said center line to a
point 15.54 rods along same from the South line of said right-of-way; thence South along
said center line to a point distant 30 rods North from the South line of the Northwest
quarter of Northwest quarter; thence West parallel with the South line thereof to the West
line of same; thence North to the point of beginning all in Section 36, Township 118,
Range 22, Hennepin Co., Minnesota. Subject to restrictions, easements or right-of-ways
of record.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval; and
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from RMF -2
(Multiple Family 2) to RMF -4 (Multiple Family 4).
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for
reclassification of the zoning from RMF -2 (Multiple Family 2) to RMF -4 (Multiple Family 4) for
the 10.3 -acre parcel located north of 11"' Avenue and west of South Shore Drive, based on the
following findings:
I. The proposed rezoning is consistent with the Comprehensive Plan and other City policies
and plans.

2. The proposed RMF -4 zoning and plat would provide both a housing type (apartment -style
condominiums) and density (12 dwelling units per acre) that is consistent with the LA -4
guiding of the site.
3. The lot would exceed the standards of the RMF -4 zoning district.
4. The proposed development would be compatible with the existing character of the
surrounding properties. Abutting properties to the south and west are zoned RMF -4.
5. Adequate infrastructure is available to support RMF -4 zoning and the development
proposed for this site.
