HomeMy WebLinkAboutCity Council Resolution 2005-112CITY OF PLYMOUTH RESOLUTION 2005-112 APPROVING SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT AMENDMENT AND VARIANCES TO ALLOW A CHURCH EXPANSION FOR ST. BARNABAS LUTHERAN CHURCH LOCATED AT 15600 OLD ROCKFORD ROAD (2005005) WHEREAS, St. Barnabas Lutheran Church has requested approval of a site plan amendment, conditional use permit amendment, and variances for an 18,292 -square foot church expansion located at 15600 Old Rockford Road, for property legally described as: Lot 1, Block 1, St. Barnabas Addition, Hennepin County, MN WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by St. Barnabas Lutheran Church for a site plan amendment, conditional use permit amendment, and variances for an 18,292 -square foot church expansion, subject to the following conditions: 1. A site plan amendment, conditional use permit amendment, and variances are approved to allow constriction of a 18,292 -square foot two-level expansion, in accordance with the application materials received by the City on January 13, 2005, and revised plans received by the City on February 17, 2005, except as amended by this resolution. �2. Variances are approved to allow a 16 -foot side yard building setback where 25 feet is required by the Zoning Ordinance, and a 6 -foot side yard parking setback where 30 feet is required by the Ordinance, based on the finding that: Resolution 2005-112 File No. 2005005 Page 2 a. The requested 16 -foot building setback variance and 6 -foot parking setback variance would allow the expansion of the building and parking area to the eastern portion of the site. St. Barnabas Lutheran Church recently purchased the residential property to the southeast which is the property directly affected by the variance requests. The church plans to eventually consolidate these properties into one lot. At that time the variance would no longer be needed. b. Because of the church's side property line arrangement, the proposed 16 -foot building setback variance applies to a small portion of the side lot line. The majority of the church would be set back at least 120 -feet from the side property line. c. The variances would allow a reasonable use of the land and would not be detrimental to the public welfare or injurious to other land in the neighborhood. The proposed setbacks would not impair an adequate supply of light and air to adjacent property, endanger public safety, increase congestion of the public streets, increase the danger of fire or substantially diminish property values in the neighborhood. d. The purpose of the variances is not based upon a desire to increase the value or income potential of the parcel of land. The proposed church expansion and parking lot addition would not increase the capacity of the church; but would rather provide a church addition for its members. 3. Prior to issuance of a building permit, a revised certified survey shall be submitted identifying the lot area and the proposed impervious surface area coverage on the property. The total impervious surfaces area coverage shall not exceed 25 percent of the lot area. 4. Prior to issuance of a building permit, a site improvement performance agreement and financial guarantee shall be submitted pursuant to Section 21045.10 of the Zoning Ordinance. 5. Prior to issuance of a building permit, a revised landscape plan shall be submitted showing 19 overstory trees (2.5 -inch for deciduous and 6 -feet for coniferous) to be planted on the subject property. The landscape plan shall show all proposed trees on the subject property. 6. Prior to issuance of a building permit, a revised landscape plan shall be submitted showing not less than 25 percent deciduous and not less than 25 percent coniferous trees. 7. Prior to issuance of a building permit, a private trail easement (in recordable form) shall be submitted to the City for the church path that crosses onto Lot 2, Block 1, St. Barnabas Addition. The easement shall be recorded at Hennepin County. 8. Prior to issuance of a building permit, a revised lighting plan shall be submitted identifying the watts per square footage for all lighting on the site per Section 21105.06 of the Zoning Ordinance. In addition, house -side shields shall be added to all fixtures located within 300 Resolution 2005-112 File No. 2005005 Page 3 feet of residential property, as required by the ordinance. The lighting plan shall be revised as necessary for all proposed lighting to be in compliance with ordinance requirements. 9. Prior to issuance of a building permit, a revised lighting plan shall be submitted identifying the bollard lights on Lot 2, Block 1, St. Barnabas Addition be removed or completely shielded from the residential home to the southeast. 10. Engineering conditions: a. Prior to issuance of a building permit, the plans shall be revised to include the following: 1. Indicate concrete curb and gutter B612, using City detail STRT-1. 2. Lower rain garden outlet overflow elevation from 964.9 to 964.6 to provide 1.5 feet of freeboard from the lowest floor to the overflow elevation. The overflow shall have at least a 4 -foot bottom width at that elevation. 3. Show drainage area to the rain garden and provide hydrologic calculations for the 1 - year, 2 -year, and 100 -year frequency storms. 4. Indicate a reinforced outlet from the rain garden with filter fabric under the rip rap. 5. A rock constriction entrance is required at the location where access is to be provided for grading and building constriction. Use City detail DWG -7 on the grading plan. 6. Storm sewer catch basin inserts are required in the constriction area. Show City detail ST -19 and ST -20, and identify locations on the grading plan. 7. Indicate on plans that the parking lot and streets are to be swept a minimum of once per week during constriction. 8. Note on page C-2 the 6 -inch by 6 -inch watermain tee and show detail. 9. Note on page C-2 a Class 52 watermain. 10. Note on page C-2 "City Of Plymouth's Current Engineering Guidelines Shall Govern". 11. Use detail SS -3 for the sanitary sewer manhole. 12. Label the forcemain as sanitary sewer forcemain on the plan and identify the type of material. 13. A minimum 5 -ton design shall be used for the parking area. A 7 -ton design shall be used for the drive aisle. Provide details. 14. Show bottom and top elevations for the proposed retaining walls. 15. Reduce the slope of the storm sewer pipe between CBMH A and the apron so the fiill flow velocity is no greater than 6 feet per second. 16. Submit a description on the grading plan of how increased volumes of runoff due to the proposed development would be minimized by limiting impervious cover and encouraging infiltration of storm water where soil conditions are appropriate. 17. Submit a description on the grading plan of how alternative landscape techniques and materials will reduce rates and volumes of runoff. 18. Identify on the grading plan all reasonable steps to avoid water quality impact and mitigate with appropriate best management practices (BMWs) to prevent water quality in receiving waters from falling below established standards. Resolution 2005-112 File No. 2005005 Page 4 b. Prior to issuance of a building permit, an access easement to the rain garden beginning at Old Rockford Road shall be submitted to the City. The easement shall be 15 feet wide and must not exceed a grade of 15 percent. c. Prior to issuance of a building permit, an easement for the rain garden shall be submitted to the City. d. Prior to issuance of a building permit, a rain garden agreement shall be submitted to the City. e. Prior to issuance of a building permit, all appropriate permits shall be obtained from the Bassett Creek Water Management Commission. f. Prior to the financial guarantee being released, the City requires reproducible mylar prints of sanitary sewer, water service, storm sewer and pond As-Builts for the site. g. The site plan shall comply with the City of Plymouth's current Engineering Guidelines or the State Plumbing Code, whichever applies. h. All site utilities shall comply with the State Plumbing Code. 11. Fire Conditions: a. Prior to issuance of a building permit, the plans shall be revised to include the following: 1. Identify location of fire apparatus access road signage. 2. Identify relocated and added fire hydrants in locations approved by the City Fire Inspector. 3. Submit fire flow calculations flowing the remote two hydrants simultaneously. Each hydrant shall be capable of flowing a minimum of 1,500 GPM at 20 PSI residual pressure. 4. All drive aisles shall be identified as fire lanes and constricted to minimum fire lane constriction requirements. All damaged fire lanes shall be repaired to a 7 -ton driving capacity. Include fire lane sign locations and constriction details for the fire lane on the site plan. b. The entire building shall be protected by a City approved NFPA 13 Automatic Fire sprinkler system. c. A building fire sprinkler system and fire alarm system shall be monitored by an approved LTL central station with a UL certificate on the system. The PIV and all system control valves with the system flow switches shall be monitored by the UL central station. d. An approved solenoid device is required to be connected between the building domestic water supply and the building fire sprinkler system. Activation of the fire sprinkler system shall shut off all domestic water on the site. e. Locate the Fire Department connection in an approved location on the south side of the building. f. An approved City of Plymouth Fire Department lockbox must be installed in an approved location near the main entry door on the south side of the building. g. An 8 1/2 inch x 11 inch "As -Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds, per City Policy. h. Fire Lane signage must be installed in locations as identified by the Fire Inspector. Resolution 2005-112 File No. 2005005 Page 5 i. The locations of post -indicator valves, and fire department connections shall be approved by the Fire Inspector. 12. A building permit shall be obtained for all retaining walls exceeding four feet. The walls shall be designed and certified by a structural engineer. In addition, a three-foot high fence is required on top of all retaining walls exceeding four feet. 13. Silt fence shall be installed prior to any constriction on the site. 14. The building official must approve the sanitary sewer forcemain, or the connection must be made inside the building 15. The minimum floor elevation shall be 966.0. 16. Erosion Control blanket is required on all slopes 3:1 and greater. 17. Standard Conditions: a. The applicant shall remove any diseased or hazardous trees. b. All signage shall comply with the Section 21155 of the Zoning Ordinance. c. Building permits are required prior to the commencement of any constriction related to the project. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21015.07 of the Zoning Ordinance.
