HomeMy WebLinkAboutCity Council Resolution 2005-111CITY OF PLYMOUTH RESOLUTION 2005-111 APPROVING AN INTERIM USE PERMIT FOR UNTIEDT' S GARDEN MARKET TO OPERATE A SEASONAL MARKET LOCATED AT 1605 COUNTY ROAD 101 (2005004) WHEREAS, Untiedt's Garden Market has requested approval of an interim use permit to operate a seasonal market on property legally described as follows: Tract C, Registered Land Survey No. 1301, Files of Registrar of Title, County of Hennepin. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the interim use permit for Untiedt's Garden Market to operate a seasonal market on property located at 1605 County Road 101, subject to the following conditions: 1. This interim use permit is approved to allow a spring and fall garden market sale from April 20, 2005, to July 15, 2005, and from September 15, 2005 to November 1, 2005, in accordance with the application and plans received by the City on January 12, 2005. 2. The interim use permit shall terminate on November 1, 2005. 3. Products shall be limited to produce, vegetables, flowers, and plants. Other accessory items may be sold provided there are clearly incidental to the sale of produce, flowers, and plants. 4. The display of merchandise on unpaved landscaped areas shall be prohibited. 5. The hours of operation shall be limited to 9:00 a.m. to 7:00 p.m. Resolution 2005-111 (2005004) Page 2 6. Signage related to this use shall be in compliance with Section 21155.03, Subd. 4 (e) (2) of the Zoning Ordinance, as follows: 1) one (16) square foot sign has been approved for the sales event; 2) the sign shall be setback at least ten (10) feet from lot lines, and shall not be located in the street right of way; and 3) the sign shall be erected only during the approved period of the sale.
