HomeMy WebLinkAboutCity Council Resolution 2005-092CITY OF PLYMOUTH RESOLUTION NO. 2005-092 ACCEPTANCE OF UTILITIES FOR CONTINUAL MAINTENANCE STONE CREEK VILLAGE (2001073) WHEREAS, in accordance with the development contract dated January 29, 2003, Plymouth Leased Housing Associates, LLC., developer of Stone Creek Village (2001073), has agreed to install certain improvements for said development; and WHEREAS, the developer has completed a portion of the street, utility and site grading as noted below; and WHEREAS, the developer has requested a reduction of the required financial guarantee to reflect the completed work; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA; that the financial guarantee requirements are reduced as follows: ITEM Street Constriction Sanitary Sewer Watermain Storm Sewer Boulevard and Drainage Swale Sod Rain Garden Constriction Mitigation Pond Constriction N [_]RP Pond Constriction Street Signs (I x 200) Park and Trail Improvements Site Grading and Drainage Improvements Setting Iron Monuments Design, Administration, Inspection, As- Bullts ORIGINAL CURRENT NEW AMOUNT AMOUNT AMOUNT $ 50,825 $ 12,800 $ 12,800 12,380 6,200 -0- 1,000 300 -0- 27,100 13,600 -0- -0- -0- -0- 10,500 10,500 10,500 9,450 9,450 9,450 25,760 12,880 6,440 200 200 -0- -0- -0- -0- 123,500 30,875 6,175 750 750 750 31,376 11,707 -0- $292,841 $ 109,262 $46,115 That the required financial guarantee for the above items be reduced as detailed above from $109,262 to $46,115 to reflect the completed work. Letter of Credit No. 170 may be reduced accordingly. RESOLUTION NO. 2005-092 STONE CREEK VILLAGE (2001073) Page Two FURTHER BE IT RESOLVED that the financial guarantee requirements for the following items per Section 8.1 of the approved development contract remain as follows: ITEM Maintenance of Erosion and Sediment Control Plan, Street Sweeping, and Storm Sewer Cleaning Cash: ORIGINAL NEW AMOUNT AMOUNT $ 9,000 $9,000 FURTHER BE IT RESOLVED that the utility constriction is accepted for continual maintenance as of March 8, 2005 subject to the two-year guarantee by the Developer per Maintenance Bond No. 104374291 issued by Travelers Casualty and Surety Company of America. Adopted by the City Council on March 8, 2005.
