HomeMy WebLinkAboutCity Council Resolution 2005-076CITY OF PLYMOUTH RESOLUTION NO. 2005-076 AUTHORIZING THE VACATION OF ALL OF BIRCH PARK AND PART OF LAHTI LANE AS PLATTED IN TRANQUIL VISTA WHEREAS, a public hearing with respect to said vacation was scheduled for February 22, 2005 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of February 22, 2005; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on February 22, 2005 to inform any and all interested parties relevant to the vacation of Birch Park and part of Lahti Lane within Tranquil Vista; and WHEREAS, said platted Lahti Lane right-of-way is now known as Vinewood Lane North; and WHEREAS, it was determined by the City Council that said park and right-of-way were not needed for public purposes; and WHEREAS, affected homeowners are required to sign and submit drainage/utility easement documents for recording at Hennepin County; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following park and right-of-way be vacated: Resolution No. 2005-076 Page 2 All of Birch Park as platted in Tranquil Vista. Also, All that part of Lahti Lane as platted in Tranquil Vista lying northerly and northwesterly of the following described line: Commencing at the northwest corner of Lot 9 of said plat; thence northerly along the west line of said plat a distance of 40.00 feet to the actual point of beginning of the line to be described: Thence easterly to the most southerly point of said Birch Park; thence northeasterly along the southeasterly tangent line of said Birch Park and its northeasterly extensions to the intersection of said line and its extensions with the southwesterly right-of-way line of Spring Avenue as platted in Tranquil Vista and there terminating. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
