RESOLUTION 2005-067
APPROVING ENCROACHMENT AGREEMENT FOR DECK
CONSTRUCTION OVER LOTS 1 TO 12, BLOCK 1,
THE FIELDS OF NANTERRE THIRD ADDITION
WHEREAS, Ryland Homes Inc. has requested an encroachment agreement to allow constriction of
12 decks into common space dedicated as public drainage and utility easement; and
WHEREAS, the encroachment agreement only permits the decks to be constricted in accordance to
the plans and all related facilities must still meet all applicable City codes; and
WHEREAS, the property to which this encroachment agreement is granted is legally described as
Lots I to 12, Block 1, The Fields of Nanterre Third Addition; and
WHEREAS, the owner will be responsible to record the agreement and provide the City with an
attested recorded copy;
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on
behalf of the City of Plymouth an encroachment agreement that will allow for the constriction of
the decks to cantilever into the common space dedicated as public drainage and utility easement.
