HomeMy WebLinkAboutCity Council Resolution 2005-066CITY OF PLYMOUTH RESOLUTION NO. 2005-066 REIMBURSING DEVELOPER FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS TIMBER CREEK CROSSING (2001114) WHEREAS, in accordance with the development contract dated November 13, 2002, Orrin Thompson Homes, Inc., developer of Timber Creek Crossing (2001114), has agreed to install certain improvements for said development; WHEREAS, as part of this development, the developer was required to constrict public improvements including the widening of the Schmidt Lake Road, larger watermain, a trail along Schmidt Lake Road, Garland Lane, and 51st Avenue, and a bridge embankment for the Schmidt Lake Road bridge; and WHEREAS, the City is responsible for incremental cost of the public improvements above that which is the responsibility of the developer under the City Assessment Policy; and WHEREAS, The engineer for the Orrin Thompson Homes, Inc. development has certified that the work to date complies with the approved plans and specifications; and WHEREAS, the utilities and streets were accepted for continual maintenance at the August 12, 2003 and December 13, 2003 City Council meetings, respectively; and WHEREAS, it is appropriate to make a payment at this time; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the developer, Orrin Thompson Homes, Inc., is to be reimbursed in the amount of $250,976.48 as payment for the constriction of the public improvements including streets, watermain, trail constriction and a bridge embankment and in accordance with the development contract and City Policy. BE IT FURTHER RESOLVED that this payment in the amount of $250,976.48 be allocated according to the following table: Adopted by the City Council on February 22, 2005. Payment City Fund Schmidt Lake Road Widening $43,675.18 MSA Fund Watermain $26,544.00 Utility Trunk Fund Bridge Embankment $179,999.30 MSA Fund Trails $758.00 Park Dedication Fund Adopted by the City Council on February 22, 2005.
