RESOLUTION NO. 2005-040
REQUEST FOR PAYMENT NO. 3 & FINAL
15TH AVENUE STORM SEWER PROJECT
CITY PROJECT NO. 3130
WHEREAS, the City of Plymouth as owner and Soil -Con, Inc. as contractor, have
entered into an agreement for the 15th Avenue Strom Sewer Project, City Project No.
3101, said agreement was approved by the City Council on November 25, 2003; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $63,645.00 and the value of the
work to date is $76,408.11 and is herewith approved. This project exceeds
the original contract amount due to additional pipe replacement and
approved Change Order No. 1.
2. That the work performed by the contractor for the 15t1' Avenue Storm
Sewer Project and certified to the Council by the engineer as acceptable,
being the same, is hereby released from the contract except as to the
conditions of the performance bond, any and all legal rights of the owner,
required guarantees and correction of faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of $3,820.00 to Soil -
Con, Inc. for the 15th Avenue Strom Sewer Project is hereby approved and
the City Finance Director is hereby authorized and directed to pay the
same forthwith.
