HomeMy WebLinkAboutCity Council Resolution 2005-004CITY OF PLYMOUTH RESOLUTION 2005-004 APPROVING A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT FOR POPE ASSOCIATES INC. FOR PROVIDENCE ACADEMY LOCATED AT 15100 SCHMIDT LAKE ROAD (2004133) WHEREAS, Pope Associates Inc. has requested approval of a site plan amendment and conditional use permit for Providence Academy, located on property legally described as Lot 1, Block 1, Providence Academy. WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Pope Associates Inc. for a site plan amendment and conditional use permit for property located at 15100 Schmidt Lake Road, subject to the following conditions: 1. A site plan amendment and conditional use permit is hereby approved, in accordance with the application received by the City on September 24, 2004 and revised plans received by the City on December 1, 2004, except as may be amended by this resolution. 2. A conditional use permit is approved to allow more than one principal building on the lot. Under the amended site plan, the chapel (previously shown being attached to the main academy stricture) would be constricted as a second free-standing principal stricture on the lot. 3. Compliance with conditions established in Resolution 99-478, which approved the original site plan, conditional use permit, and variances for this site, except as may be amended by this resolution. 4. Prior to issuance of building permits for Phase 2 constriction, the applicant shall submit a revised lighting plan indicating compliance with the 25 foot height regulation, and with the wattages allowed under Section 21105.06 (exterior lighting) of the Zoning Ordinance. Resolution 2005-004 (2004133) Page 2 5. Prior to the issuance of building permits for Phase 2 constriction, the applicant shall submit a revised landscape plan showing 21 additional trees. 6. The applicant must obtain the appropriate permits from the Building Division prior to commencement of the project. 7. Prior to issuance of building permits for Phase 2 constriction, the plans shall be revised as follows: a. Show cross section of storm sewer pipes where it crosses water main, fire hydrants, and valves. Avoid conflicts with vertical and horizontal separation. b. Identify class of storm sewer pipe. c. Identify water main wet taps. Use standard City detail W-7. d. Show detail W-3 for water main bends, reference on plans. e. Show existing water main valves. f. All storm sewer catch basins and catch basin man holes require inlet protection. Make reference on plans and show standard details ST -19 and ST -20. g. Show cross section of private trail constriction per detail SPP -1. h. Proposed trail on north and west side of running track/football field is located on an access easement with the City. Because heavy equipment will destroy the pavement of a standard trail, it is required that the trail be constricted 10 feet wide to a 7 ton design standard. The flat portion of the access easement must be a minimum of 15 feet wide and at a grade that is less than 15 %. Alternatively, the owner may enter into an agreement with the City whereby they will be responsible for the restoration of said standard trail, and shoulders if damage occurs. i. Include detail page showing all City Standard Details that are applicable. j. Show rock constriction entrance locations and detail. k. Show erosion control blanket locations on slopes 3:1 and greater. 1. Show pedestrian ramp for trail on east side of property. Use detail SPP -IA. m. Use City detail for curb type and pavement design. 8. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 9. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 10. Standard Conditions: a. This approval shall expire eight (8) years after the date of approval. b. The applicant shall submit the required Financial Guarantee and Site Performance agreement prior to issuance of building permits. Resolution 2005-004 (2004133) Page 3 c. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. d. The applicant shall submit an 8 1/2 x I I inch "As Built" Fire Protection Plan prior to the release or reduction of any site improvement bonds per City Policy.
