RESOLUTION NO. 2006-493
REQUEST FOR PAYMENT NO. 2 AND FINAL
2006 TEMPORARY OVERLAY PROJECT — PHASE 2
CITY PROJECT NO. 6134
WHEREAS, the City of Plymouth as owner and FPI Paving Contractors, Inc. as contractor, have
entered into an agreement for the 2006 Temporary Overlay Project, City Project No. 6134, said
agreement was approved by the City Council on August 22, 2006; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final
request for payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA:
• That the original contract amount was $113,628.60 and the value of the work to date
is $133,466.25 and is herewith approved. This project is over the original contract
amount by 17%.
• That the work performed by the contractor for the 2006 Temporary Overlay Project -
Phase 2 and certified to the Council by the Engineer as acceptable, being the same, is
hereby released from the contract except as to the conditions of the performance
bond, any and all legal rights of the owner, required guarantees and correction of
faulty work after final payment.
• Request for Payment No. 2 and Final in the amount of $26,358.98 to FPI Paving
Contractors, Inc. for the 2006 Temporary Overlay Project -Phase 2 is hereby approved
and the City Finance Director is hereby authorized and directed to pay the same
forthwith. Funding will be from:
• 2006 Seal Coating Budget, $131,096.85
• Reimbursements received from Nathan Lane property owners, $2,531.75
