APPROVING AN EXEMPTION AND
AUTHORIZING THE MAYOR TO SIGN THE
WETLAND CONSERVATION ACT
CERTIFICATE OF EXEMPTION FORM FOR
RUSTEN WOOD DEVELOPMENT (2006046)
NWl/4 SE 1/4 SECTION 31 T118 R22W
WHEREAS, BohLand Hadley Woods, LLC is requesting a wetland replacement exemption for
filling about 350 square feet in a type 1-2 portion of wetland basin as part of the proposed Rusten
Wood development; and
WHEREAS, the proposed filling is less than the 400 square feet de minimus allowed under the
Minnesota Wetland Conservation Act for a type 1-2 wetland pursuant to MN Rule Chapter,
8420.0122. Subp. 9 (3);
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that the exemption is approved and the Mayor is authorized to
execute a Certificate of Exemption Form with BohLand Hadley Woods, LLC for the proposed
Rusten Wood development.
