HomeMy WebLinkAboutCity Council Resolution 2006-466CITY OF PLYMOUTH RESOLUTION NO. 2006-466 IMPOSING A CIVIL PENALTY AGAINST WOODY'S GRILLE FOR LIQUOR COMPLIANCE CHECK VIOLATION WHEREAS, the Plymouth Police Department routinely conducts compliance checks on licensed liquor establishments within the City; and WHEREAS, during one of these checks conducted on June 3, 2006, an individual employed at Woody's Grille, 220 Carlson Parkway, sold an alcoholic beverage to an underage person; and WHEREAS, that individual has appeared in Hennepin County District Court and been found guilty of this violation; and WHEREAS, this establishment had a previous compliance check violation which occurred on October 15, 2005, which is within the three year period the ordinance requires making this the second violation at this establishment; and WHEREAS, Minnesota Statute and Plymouth City Code allow for administrative civil penalties against the license holders for such violations, NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, that the City Council adopts the Resolution imposing a civil penalty against Woody's Grille for: Imposition of a $1,000 fine and 5 -day suspension stayed (according the Best Practices Penalty Grid for a second violation) The licensee conducts TIPS Training at their own expense, for all liquor license holders in the City. After one year, this program will be evaluated by the City Council. Adopted by the City Council on November 14, 2006.
