RESOLUTION NO. 2006-446
REQUEST FOR PAYMENT NO. 3 AND FINAL
2006 MILL AND OVERLAY PROJECT
CITY PROJECT NO. 6106
WHEREAS, the City of Plymouth as owner and Northwest Asphalt, Inc. as contractor,
have entered into an agreement for the 2006 Mill and Overlay Project, City Project No.
6106, said agreement was approved by the City Council on May 9, 2006; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $338,309.55 and the value of the
work to date is $350,444.14 and is herewith approved. This project is
above the original contract amount by 4%.
2. That the work performed by the contractor for the 2006 Mill and Overlay
Project No. 6106 and certified to the Council by the engineer as
acceptable, being the same, is hereby released from the contract except as
to the conditions of the performance bond, any and all legal rights of the
owner, required guarantees and correction of faulty work after final
payment.
3. Request for Payment No. 3 and Final in the amount of $29,052.58 to
Northwest Asphalt, Inc. for the 2006 Mill and Overlay Project, City
Project No. 6106 is hereby approved and the City Finance Director is
hereby authorized and directed to pay the same forthwith. Funding will be
from the Street Replacement Fund, Special Assessments, the Municipal
State Aid Fund and the Community Improvement Fund.
