RESOLUTION NO. 2006-445
REQUEST FOR PAYMENT NO. 2 AND FINAL
WALNUT GROVE LANE RETAINING WALL PROJECT
CITY PROJECT NO. 6104
WHEREAS, the City of Plymouth as owner and TMS Constriction, Inc. as contractor,
have entered into an agreement for the Walnut Grove Lane Retaining Wall Project, City
Project No. 6104, said agreement was approved by the City Council on May 23, 2006;
and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $64,515.90 and the value of the
work to date is $69,858.70 and is herewith approved. This project is
above the original contract amount by 8%.
2. That the work performed by the contractor for the Walnut Grove Lane
Retaining Wall Project No. 6104 and certified to the Council by the
engineer as acceptable, being the same, is hereby released from the
contract except as to the conditions of the performance bond, any and all
legal rights of the owner, required guarantees and correction of faulty
work after final payment.
3. Request for Payment No. 2 and Final in the amount of $3,492.93 to TMS
Constriction, Inc. for the Walnut Grove Lane Retaining Wall Project No.
6104 is hereby approved and the City Finance Director is hereby
authorized and directed to pay the same forthwith. Funding will be from
the Street Reconstruction Fund.
