HomeMy WebLinkAboutCity Council Resolution 2006-442CITY OF PLYMOUTH RESOLUTION NO. 2006-442 REQUEST FOR PAYMENT NO. 5 AND FINAL BEST MANAGEMENT PRACTICES IMPLEMENTATION PROJECT CITY PROJECT NO. 4119E WHEREAS, the City of Plymouth as owner and Sunram Constriction Inc. as contractor, have entered into an agreement for the Best Management Practices Implementation Project, City Project No. 4119E, said agreement was approved by the City Council on April 25, 2004; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $128,957.28 and the value of the work to date is $124,689.81 and is herewith approved. This project is below the original contract amount by 3.3%. 2. That the work performed by the contractor for the Best Management Practices Implementation Project No. 4119E and certified to the Council by the engineer as acceptable, being the same, is hereby released from the contract except as to any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 5 and Final in the amount of $6,234.49 to Sunram Constriction, Inc. for the Best Management Practice Implementation Project is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. Adopted by the City Council on November 14, 2006.
