HomeMy WebLinkAboutCity Council Resolution 2006-438CITY OF PLYMOUTH RESOLUTION 2006-438 APPROVING A SITE PLAN AMENDMENT TO CONSTRUCT A CREDIT UNION WITH DRIVE-THROUGH AT ROCKFORD ROAD PLAZA FOR PROPERTY LOCATED AT 4190 VINEWOOD LANE (2006097) WHEREAS, HTG Architects has requested approval of a site plan amendment to constrict a credit union with a drive-through at Rockford Road Plaza, for property legally described as: Parcel 1: Lots 1, 2 and 3, Block 2, Rockford Road Plaza, Hennepin County, Minnesota. Together with appurtenant easements created pursuant to operation and easement agreement document nos. 5657803 (A) and 2090515 (T), as amended by first amendment to operation and easement agreement document nos. 5837189 (A) and 2211572 (T), as further amended by second amendment to operation and easement agreement document nos. 5873453 (A) and 2233563 (T), as further amended by third amendment to operation and easement agreement document nos. 6167343 (A) and 2432725 (T). Together with appurtenant easements created pursuant to declaration of covenants, restrictions and easement for parking and roadway purposes document nos. 5723648 (A) and 2165753 (T), as amended by supplemental to declaration of covenants, restrictions and easement for parking and roadway purposes document nos. 5850324 (A) and 2261099 (T). Together with appurtenant easements created pursuant to declaration of covenants, restrictions and easements for utility purposes document nos. 5744659 (A) and 2157320 (T). A portion of the above land being registered property as follows: That part of Lot 1, Block 2, Rockford Road Plaza, embraced within the southeast quarter of the northeast quarter of Section 15, Township 118, Range 22. That part of Lot 2, Block 2, Rockford Road Plaza, embraced within the southeast quarter of the northeast quarter and the northeast quarter of the southeast quarter of Section 15, Township 118, Range 22. Together with appurtenant easements created pursuant to operation and easement agreement document nos. 5657803 (A) and 2090515 (T), as amended by first amendment to operation and easement agreement document nos. 5837189 (A) and 2211572 (T), as further amended by second amendment to operation and easement agreement document nos. 5873453 (A) and 2233563 (T), as further amended by third amendment to operation and easement agreement document nos. 6167343 (A) and 2432725 (T). A portion of the above land being registered property as follows: That part of Outlot B, Rockford Road Plaza, embraced within the southeast quarter of the northeast quarter of Section 15, Township 118, Range 22. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by the HTG Architects for a site plan amendment to allow constriction of a credit union with drive- through at Rockford Road Plaza, subject to the following conditions: 1. A site plan amendment to allow constriction of a credit union is approved in accordance with the application materials received by the City on September 21, October 17 and 18, and November 6, 2006, subject to the conditions listed below. 2. Prior to any construction -related activity on the site, the applicant is responsible for acquiring a separate building permit through the Building Department. 3. Prior to issuance of a building permit, the applicant shall 1) provide a copy of the approval from the Basset Creek Water Management Commission, 2) execute a site improvement performance agreement and submit the required financial guarantees pursuant to Section 21045.10 of the Zoning Ordinance, 3) revise the plans to include directional signage and striping within the drive-through to advise drivers on the necessary vehicle position relative to the location of the drive-through lane, and 4) revise the plans to add "Do Not Enter" signs at the drive-through service lane's exit. 4. The existing gate must remain to allow access between the existing fire hydrant and the existing fire lane. The area between the gate and the hydrant must be kept clear of plants. Additionally, no plants shall be installed within three feet of the hydrant. 5. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 6. Approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project. The landowner or applicant Resolution 2006-438 File No. 2006096 Page 3 may apply for approval of an extension by the City, as regulated under Section 21045.09 of the Zoning Ordinance.
