RESOLUTION 2006-435
APPROVING A CONDITIONAL USE PERMIT FOR CARLSON REAL ESTATE
COMPANY FOR A SPORTS AND FITNESS CLUB LOCATED AT 14100 CARLSON
PARKWAY (2006089)
WHEREAS, Carlson Real Estate Company has requested approval of a conditional use
permit to allow a sports and fitness club called "Accelerated Sports Therapy and Fitness"
for property located at 14100 Carlson Parkway, legally described as follows:
That part of Lot 1, Block 1, Carlson Center Second Addition, according to the
recorded plat thereof, lying Westerly of the following described Line 1 and Northerly
of the following described Line 2 and its extension.
Line 1
Commencing at the Northeast corner of said lot; thence South 89 degrees 34
minutes 25 seconds West, assumed bearing, a distance of 420.51 feet along the
Northerly line of said lot to the point of beginning of the Line to be described; thence
South 0 degrees 26 minutes 07 seconds East a distance of 546.68 feet to the
Southeasterly line of said lot and there terminating.

Beginning at a point on the above described Line 1 distant 307.41 feet Southerly of
the point of beginning of said Line 1; thence West a distance of 49.71 feet; thence
North 44 degrees 22 minutes 19 seconds West a distance of 48.51 feet; thence South
70 degrees 33 minutes 53 seconds West a distance of 395.06 feet to the West line of
said Lot 1 and said line there terminating.

WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing, and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Carlson Real Estate Company for a conditional use permit for a sports and
fitness club at 14100 Carlson Parkway, subject to the following conditions:
1. A conditional use permit is hereby approved in accordance with the application and
plans received by the City on September 6, 2006, except as may be amended by this
resolution.
2. The conditional use permit allows a 6,000 square foot sports and fitness club in the I-1
(Light Industrial) zoning district, based on the finding that all applicable conditional
use standards have been met.
3. Prior to construction of tenant improvements to or within the building, the
applicant must obtain separate approval of a building permit.
4. Standard Conditions:
a. Any signage shall be in compliance with the City's sign regulations, and shall
receive prior approval of the appropriate sign permit.
b. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
c. This permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
d. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless
the landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 21015.07
of the Zoning Ordinance.
