HomeMy WebLinkAboutCity Council Resolution 2006-433CITY OF PLYMOUTH RESOLUTION 2006-433 APPROVING A SITE PLAN AND CONDITIONAL USE PERMIT FOR CHILDREN'S DESIGN GROUP FOR A CHILD CARE AND EARLY CHILDHOOD EDUCATION CENTER FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF OLD ROCKFORD ROAD AND PEONY LANE (2006081) WHEREAS, Children's Design Group has requested approval of a site plan and conditional use permit to allow constriction of a 10,990 square -foot child care and early childhood education center to be called "Primrose School of Plymouth" on the 2.4 -acre site located at the southeast corner of Old Rockford Road and Peony Lane, legally described as Lot 1, Block 1, Rockford Glenn 4"' Addition, Hennepin County Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Children's Design Group for approval of a site plan and conditional use permit for a child care and early childhood education center at the southeast corner of Old Rockford Road and Peony Lane, subject to the following conditions: I. A site plan and conditional use permit is hereby approved in accordance with the architectural drawings received by the City on August 10, 2006, the lighting plan received by the City on September 5, 2006, and the revised civil and landscape drawings received by the City on October 10, 2006, except as may be amended by this resolution. 2. The conditional use permit allows a day care facility in the C -I (Convenience Commercial) zoning district, based on the finding that all applicable conditional use standards have been met. Resolution 2006-433 (2006081) Page 2 3. Prior to construction of the building, the applicant must obtain separate approval of a building permit. 4. Prior to issuance of building permits, the following items shall be completed: a. The developer shall submit the required Financial Guarantee and Site Improvement Performance Agreement. b. The applicant shall pay the park dedication fee in lieu of land dedication, in accordance with the Dedication Ordinance in effect at the time of building permit issuance. c. A ten -foot wide drainage and utility easement shall be provided along Old Rockford Road and Peony Lane; a six-foot wide drainage and utility easement shall be provided along the east plat boundary line; and a 20 -foot wide drainage and utility easement shall be provided for the existing sanitary sewer pipe. d. A drainage and utility easement shall be provided to the high water elevation of the water -quality pond, and for the wetland located south of the 20 -foot wide sewer line easement. e. The developer shall obtain the necessary permits and approvals as follows: Bassett Creek Watershed Management Organization, Minnesota Department of Health, MPCA, and NPDES. 5. Prior to issuance of building permits, the plans shall be revised as follows: a. Indicate the location of required fire lane signage on the site plan. b. The north gate of the enclosed playground area must be relocated easterly to the paved area, and must swing outward. c. The sidewalk located west of the HVAC fence enclosure must provide a paved, 48 -inch wide clear path of travel. d. The location of the silt fence must be shown on the grading plan. e. Identify rip rap class and quantity, with filter fabric for the storm sewer pipe under the driveway entrance, and for the emergency overflow on the N [_]RP pond. f. Identify on the plans the limits of trail impacts relative to site grading and note trail repair. 6. Standard Conditions: a. Any signage shall be in compliance with the City's sign regulations, and shall receive prior approval of the appropriate sign permit. b. An approved fire lock box is required at the main building entrance. c. The applicant shall submit a reproducible 8 '/z x 11 inch "As Built" Fire Protection Plan prior to the release or reduction of any site improvement financial guarantee. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. Resolution 2006-433 (2006081) Page 3 e. This permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning Ordinance.
