HomeMy WebLinkAboutCity Council Resolution 2006-411CITY OF PLYMOUTH RESOLUTION NO. 2006-411 AUTHORIZING THE VACATION OF A DRAINAGE AND UTILITY EASEMENT AS LEGALLY DESCRIBED IN DOCUMENT NO. 8812450 WHICH LIES WITHIN LOT 2, BLOCK 1, EPIPHANY SECOND ADDITION WHEREAS, a public hearing with respect to said vacation was scheduled for October 10, 2006 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of October 10, 2006; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on October 10, 2006 to inform any and all interested parties relevant to the vacation of a drainage and utility easement within Lot 2, Block 1, Epiphany Second Addition; and WHEREAS, it was determined by the City Council that said easement was not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage and utility easement be vacated: A 12.00 foot easement for drainage and utility purposes over, under and across that part of Lot 2, Block 1, Epiphany Second Addition, Hennepin County, Minnesota. The centerline is described as follows: Commencing at the southwest corner of said Lot 2; thence on an assumed bearing of East, along the south line of said Lot 2, a distance of 104.92 feet to the point of beginning of the centerline to be described; thence North 06 degrees 02 minutes 14 seconds West, a distance of Resolution No. 2006-411 Page 2 214.96 feet; thence South 89 degrees 57 minutes 57 seconds West, a distance of 49.08 feet to the west line of said Lot 2 and centerline there terminating. The sidelines of said easement are to be prolonged or shortened to commence at the south line of said Lot 2 and terminate at the west line of said Lot 2. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
